Understanding The Conveyancing Process
1. If you are buying or selling your house, you may want to
employ a conveyancing service so as to get the deal
fulfilled. This is a important element of the process of
buying or selling a property, which cannot be overlooked
by either side.
2. However , it is always much better to understand the
conveyancing procedure, so as to keep up with what your
solicitor is doing and be in a position to follow the
procedure from beginning to end without worrying about
what could occur next. By learning what the process
implies to both the buyer and the seller, you may know
why your solicitor is doing what he is doing and what you
should do in order to help them.
3. When you are the buyer , the conveyancing process begins
when you make an offer on the property and organize the
survey. Your solicitor will begin the process by requesting
for a contract pack from the seller's solicitor. They would
carry out authority searches to determine that the
property is lawfully for sale and then give you with a
report.
4. If you're the seller or are part of a chain where you want
to sell your house and purchase a property, then you will
need to complete the seller's conveyancing procedure
through your own solicitor. The seller needs to instruct a
solicitor from the outset. They would usually receive a
letter which outlines the Client Care and this needs to be
signed and returned by the seller , together with details of
the current mortgage on the house and proof of identity.
5. The solicitor would then send you a number of forms, that
need to be filled out by the seller. While you are doing
this, your conveyancing solicitor will obtain the deeds to
the house, and a duplicate for the Land Registry
information for your property. Once they are received, the
solicitor could then draw up a contract and send the
contract pack to the buyer's solicitor. Completion dates
and mortgage confirmations would also be completed by
the solicitor, before the finalised contract is drawn up and
sent to you for a signature. The ultimate thing which the
seller's solicitor would do is to exchange contracts and
take possession of the buyer's deposit.
