2. FLEXITANK HISTORY
Developed in the U.K. around 1974, the first flexitanks transported wine, edible oils
and food grade products primarily between Northern Europe and Australia/New
Zealand.

While early 2000’s saw improvements in the flexitank film and construction, major
changes were also happening to bulkheads, switching from wooden to metal.

Cleanup costs resulting from leaking flexitanks can range from $5000 USD for less than a
gallon leak to hundreds of thousands of dollars for major leaks or spills onboard ships or
in port areas.

railroads. These costs can run very high if the flexitank manufacturer or their emergency response
representative is unable or unwilling to react quickly to minimize the rising demurrage costs.

27. 7. INSURANCE REQUIREMENTS
The Container Owners Association (COA) stipulates that flexitank manufacturers and
operators carry a minimum of $5 million of product liability insurance.

28. INSURANCE REQUIREMENTS

• LIMITATION OF WARRANTY: All of the Seller's products are carefully inspected.
Flexitanks are packed in a shipping bag for optimum protection during shipment.
Seller warrants the product for 12 months from date of purchase. Products will be
replaced only during the warranty period, only if they have manufacturing defects and
only after they have been returned to nonls lhe product for inspection. The Seller
offers a replacement warranty on the from the dote products, not on the products
carried therein.
•
• The Seller shall be under no liability under the above warranty (or any other warranty,
condition or guarantee) if the total price of the products sold has not been paid. The
Seller will not be liable for special, indirect or consequential damages (including, but
not limited to loss of profits) resulting from or in any way related to Seller’s products.

29. The SELLER warrants that the FLEXITANKS will be of satisfactory quality and be free from defects in workmanship for a
period of 6 months from the date of their delivery and will comply with any specification agreed for them, only if the
FLEXITANKS have been stored in compliance with the SELLERS guidelines and or instructions. Where it is alleged that the
SELLER is in breach of this warranty, precise details of the breach must be supplied by the PURCHASER to the SELLER as soon
as practicable. In the case where overt defects have been proven and therefore where a breach of warranty exists with
regards to satisfactory quality, the cost of the returning FLEXITANKS containing such defects to the SELLER and the cost of
returning such FLEXITANKS to the SELLER shall be reimbursed by the SELLER. No FLEXITANKS may be returned to the SELLER
without its express and prior approval. All other liability howsoever arising is excluded to the widest possible extent
permitted by law.
15. In the event of any breach of warranty contained in clause 14 above the SELLER´s liability shall be limited to:-
a. Replacement or repair of the FLEXITANKS in question together with reimbursement of the PURCHASER´s reasonable costs
of returning the FLEXITANKS to the SELLER; or
b. At the SELLER´s option repayment of the price (where it has been paid) for the FLEXITANKS
c. Providing a refund as a compensation for loss of contents in the FLEXITANKS with a maximum refund of $1000 per tonne
carried or $25000 per FLEXITANK where the SELLER´s liability for the loss or damage is covered by the SELLER´s insurance
cover. If for any reason (other than the SELLER´s failiure to pay the insurance premium where insurance is reasonably
available) the loss or damage is not covered by the SELLER´s insurance cover then, the entire liability of the SELLER in
accordance with this sub-clause shall not exceed $500.
d. Providing a refund as a compensation for cleaning operations, transfer of goods and/or other logistics operations directly
caused by the defective Flexitank with a maximum of $10.000 per FLEXITANK. If for any reason (other than the SELLER´s
failiure to pay the insurance premium where insurance is reasonably available) the loss or damage is not covered by the
SELLER´s insurance cover then, the entire liability of the SELLER in accordance with this sub-clause shall not exceed $500.

30. 8. DISPOSAL ASSISTANCE
Flexitanks are an environmentally sound type of packaging and a great alternative to non-recyclable
packaging. Flexitanks can either be recycled and reground, incinerated or landfilled when
necessary. If you do not already have an recycle program, be sure that your flexitank provider can
assist if necessary.

31. 9. CUSTOMER REFERRALS
It is a good idea to ask your flexitank manufacturer for customer referrals before choosing
your provider. Request a list of customer referrals who are currently using the product and
shipping similar commodities with similar sail times.
