AMENDED ORDER GRANTING PLAINTIFF’S MOTION FOR LEAVE TO EXTEND
TIME TO RESPOND TO THE COURT’S ORDER FOR
SECOND MOTION FOR SUMMARY JUDGMENT
Presently pending before the Court is the Plaintiff’s Motion for Leave to Extend
Time to Respond to the Court’s Order for Second Motion for Summary Judgment (DE #
121). In that Motion, the pro se Plaintiff requests that he be given a brief extension of
time until October 31, 2012 in which to file his Second Motion for Summary Judgment
due to his absence from this country for medical treatment.1
Based upon a thorough review of the record, and considering the Plaintiff’s pro
se status, it is

Although the Plaintiff has styled the Motion as a request for extension of time to
respond to the Court’s Order for Second Motion for Summary Judgment, the body of the
Motion requests that the Plaintiff be granted additional time to respond to the
Defendants’ Supplemental Motion for Summary Judgment. However, the Plaintiff has
already responded to the Defendants’ Supplemental Motion for Summary Judgment (DE
# 111) and also filed a Sur-Reply to that Motion (DE ## 114, 115). In addition, the October
19, 2012 date referenced in the Plaintiff’s Motion was the deadline date for the Plaintiff to
re-file his Motion for Summary Judgment (DE # 119 at 16). Therefore, the undersigned
construes the instant Motion as one seeking additional time for the Plaintiff to re-file his
Motion for Summary Judgment. The Plaintiff may not file an additional response or reply
to the Defendants’ Supplemental Motion for Summary Judgment, as the Plaintiff has
already had the opportunity to fully respond to that Motion.

ORDERED AND ADJUDGED that the Plaintiff’s Motion for Leave to Extend Time
to Respond to the Court’s Order for Second Motion for Summary Judgment (DE # 121) is
GRANTED. The Plaintiff shall file his renewed Motion for Summary Judgment if he
elects to file such a Motion, on or before Wednesday, October 31, 2012. The Defendants
shall have until November 16, 2012 in which to file a Response to the Plaintiff’s Second
Motion for Summary Judgment, and the Plaintiff may file a Reply on or before November
27, 2012.
