                  ORDER GRANTING PLAINTIFF’S MOTION FOR EXTENSION
                      OF TIME AND VACATING SCHEDULING ORDER

         This matter is before the Court upon Plaintiff’s Motion for Leave to Extend Time to

  Respond to Defendants’ Supplemental Motion for Summary Judgment (DE # 104).

  Defendants have filed no response. The Honorable Patricia A. Seitz, United States

  District Judge, has referred this case to the undersigned Magistrate Judge with respect

  to all further proceedings (DE # 100).

         Defendants filed their Supplemental Motion for Summary Judgment (DE # 103) on

  April 12, 2012, and a response was due April 30, 2012. Plaintiff seeks to have until June

  30, 2012, to file a response to Defendants’ Supplemental Motion.1 Plaintiff explains that

  the death of his mother, as well as his own personal health issues, have delayed his

  response to Defendants’ Supplemental Motion. Plaintiff’s Motion appears to be

  unopposed since Defendants have not filed a response, and the deadline for doing so

  has passed. Noting no opposition to the requested relief, and raising none sua sponte,

  the undersigned grants Plaintiff’s Motion.

         The granting of Plaintiff’s Motion, however, requires vacating the scheduling order

  in this case, which establishes certain dates and deadlines regarding the trial and pretrial

  matters. This is necessary in order for the Court to consider the parties’ Motions for

  Summary Judgment, as well as other motions pending before the Court, before

  proceeding to trial. Therefore, the current scheduling order contained in the Order

  Setting Trial Date, Pretrial Deadlines and Referral to Magistrate (DE # 44) is hereby

  vacated. A new scheduling order will be entered as necessary, after the Court has

  addressed the pending Motions for Summary Judgment. Therefore, for the reasons

  stated above, it is hereby

         ORDERED AND ADJUDGED that Plaintiff’s Motion for Leave to Extend Time to

  Respond to Defendants’ Supplemental Motion for Summary Judgment (DE # 104) is

  GRANTED. Plaintiff shall file his response to Defendants’ Supplemental Motion for

  Summary Judgment (DE # 103) on or before July 2, 2012. It is further

         ORDERED that the Order Setting Trial Date, Pretrial Deadlines and Referral to

  Magistrate (DE # 44) is VACATED.

         DONE AND ORDERED at Miami, Florida, on May 21, 2012.
