For the most part, these claims are the BAIT that
gets you to call. The truth is that very few meet the
criteria for an Offer in Compromise.

The most common resolution of tax disputes, but it is
extremely important to make sure the tax assessment is
correct, before agreeing to pay. In other words, you must
work through several of the other alternatives before any
final installment agreement.
We have seen too many folks

"just tell me how to make this go
away."

The IRS is highly computerized and this can lead to many
"disconnects" between your return as filed and their records.
GUESS WHAT? It is your responsibilitiy to find and correct
these errors! A thorough understanding of IRS adjustments
can help you pinpoint where they have incorrectly
processed your tax return.
If you haven't filed your tax returns for a few years, the IRS
will step in and create a Substitute For Return with the partial
bits and pieces they have in their computerized records of
W-2s and 1099s.
By preparing those returns, you can get a more favorable
result. In addition the IRS will require you get current on
unfiled returns before agreeing to settle or negotiate your
liability.

If you don't have a recurring history of tax deficiencies and
you can show that your situation was due to an inadvertent
mistake, unemployment, an illness or incorrect tax
advice, you may be able to get some portion of assessed
penalties abated for Reasonable Cause.
The IRS understands that married couples filing joint
returns don't always share information or have a complete
understanding of the tax positions taken on, or income
items omitted from a return.
If you can show that you were not aware of disputed tax
treatments taken on your joint return, you may be able to get
relief from tax assessed on those issues.

This is an important tool for getting you relief and
protecting you from liens, levies and garnishments. CNC
status puts all collection activities on hold, sometimes for
years. This provides much needed time to find a solution
or to get your financial affairs in order.
Prepare a Form 433-F financial statement and work with
an IRS associate to request the status.
You might assume that Uncle Sam would never discharge
tax liabilities through bankruptcy, but that is not the case.
Tax liabilities may be discharged along with other debts
through Chapter 7 bankruptcy.
Clearly this is not an option
you should attempt without
professional help.
8. OFFER IN COMPROMISE

Form 656
The IRS has an online prequalification tool that should
give you an indication of whether you should request an
OIC. You will also hear about the FRESH START
program in which the IRS has loosened its criteria a bit to
enable more taxpayers to use OIC.
If you meet the criteria, and your case is accepted, you
really can dramatically reduce the tax you will pay.
But please don't hold your breath!

9. Which Alternative May Work For Me?
STATUTE EXPIRATION
Finally, if you can fend off the IRS and ignore their pursuit
and keep them out of your bank accounts for 10 years from
the date they assessed you additional tax, they must drop
your case under the statute of limitation on tax collections.
this is very hard to achieve, because most folks owe
taxes for a number of tax years, and if you never filed a
return for a certain year, the statute of limitations
NEVER closes.
Practically,
This approach will certainly never give
you peace of mind.
