In Spain, if a building was illegally executed but ordering
its demolition is no longer possible, because the time
when legal restoration options were applicable is over,
then it will be possible to register the Statement of the
New Finished Building. In Andalusia, the time frame
when the Administration can act against cases of illegal
construction is determined by the Andalusian Law on
Urban Planning (LOUA), which currently establishes it
in six years since the final completion of the works.

Antiquity CertificatesAntiquity Certificates
An Antiquity Certificate is a document normally used in
cases of prescribed urban infraction, in order to apply for
the insertion of the Statement of New Finished Building
in the Property Registry.

A proper Antiquity Certificate ought to contain, at
least, the following information:
purpose of the Antiquity Certificate
justification for the estimated antiquity, based on the
use of documents as evidence
description of the building -which will match the one
in the Title Deed-
statement about invalidity for legalization purposes.

Limitations on the RightsLimitations on the Rights
Even if insertion in the Property Registry gets granted, an
illegal building will always have limited property rights,
due to non-compliance of urban planning regulations.
