H. R. 3261 Stop Online Piracy Act
To promote prosperity, creativity, entrepreneurship, and innovation by
combating the theft of U.S. property, and for other purposes.

Review:
Sec. 101. Definitions.
In this title:

7        (1) DOMAIN NAME.—The term ‘‘domain name’’

8        has the meaning given that term in section 45 of the

9        Lanham Act (15 U.S.C. 1127) and includes any

10       subdomain designation using such domain name as

11       part of an electronic address on the Internet to iden -

12       tify a unique online location.

The United States includes and embraces all territory which is under its
jurisdiction and control. This includes any person, corporation, firm, union,
association, or other entity capable of suing and being sued in a court of law.

“Applicant” and “registrant” embrace the legal representatives, predecessors,
successors and assigns of such applicant or registrant.

“Director” means, Under Secretary of Commerce for Intellectual Property and
Director of the United States Patent and Trademark Office.

Related company. The term “related company” means any person whose use of a
mark is controlled by the owner of the mark with respect to the nature and
quality of the goods or services on or in connection with which the mark is used.

Layman’s Terms:
A Domain name, including any sub domain; is a legal, identifiable name,
representing part of an online web address, or location on the internet.

A domain name is acquired through an application process between a registrar
and registrant; and can be controlled, transferred and operated by a person,
business, or organization.

If the person, business or entity resides in the United States; then said domain
name is governed by the Secretary Of Commerce for Intellectual Property, and
director of the U.S. Patent and Trademark Office; and falls in the jurisdiction and
control of the United States.

13       (2) DOMAIN NAME SYSTEM SERVER.—The term

14       ‘‘domain name system server’’ means a server or

15       other mechanism used to provide the Internet pro-

16       tocol address associated with a domain name.
