INJUNCTION CITY



There is an old adage about when you come to a fork in the road you should stop and pick it up because
you never know when you would need one. When, however, you come to a junction you have to make
a choice about which direction to take and then you proceed. And when you come to an injunction,
you have to come to a complete standstill and cannot move forward until you deal with it to the
satisfaction of the judiciary.



An injunction is a time-consuming and costly exercise for all parties. However, the person or
organization filing an injunction does not have as much pressure on it, and does not require as much
effort and expenditure as those against which it is filed. Some people have got away with truly
frivolous injunctions.



There is a Jamaican One-Act play called “Junction Village”. The way things are going these days
Basseterre will become “Injunction City”. Injunctions flowing from the PAM Opposition like runs
from Brian Lara’s bat. The way they’re going, it would not surprise any Kittitian if PAM sets a world
record for injunctions.



Sometimes if something is a harmless pastime you let it pass- like somebody talking to himself and
then asking “Eh? What you say?” But when one man’s or one party’s hobby poses serious problems to
the democratic process, this is not something you can ignore far less support.



In the case of the injudicious use of injunctions by the PAM, they are keeping national elections from
taking place. They are frustrating the democratic process because they are hoping that if you tell a lie
often enough and for long enough people will eventually believe it. The PAM leadership is hoping that
they could buy time with injunctions which they could use to undermine the Labour Party
Government. It is a cynical abuse of process and the institutions that uphold democracy in our country.



But you can’t really blame a desperate man for trying a thing. You know you’re down and out and you
try to latch on to what seems a good idea. The problem is when they make it a habit and convince
themselves they are doing the right thing.



The whole recurring injunction business started on a false premise by PAM and a false promise to the
people of St Kitts/Nevis that PAM will win the election. It was all bravado it is true but knowing the
shame that they would suffer they thought of a way to delay the inevitable defeat and exposure as
blusterers.



They came up with an injunction to stop something that is the prerogative of the Government and one
that it was mandated to accomplish. The urgency of the need to review the electoral boundaries was
one of the primary recommendations of the Commonwealth group of observers, led by the present
Barbados Prime Minister, Mr. David Thompson, following the last general election in 2004. In fact,
Attorney Hal Gollop made it abundantly clear, “It is important for every single person to understand
that there must be no shred of doubt that the PM has indeed acted with total legal propriety and has
upheld the law in this exercise totally. The PM has acted in accordance with the law of the Federation
of St Kitts and Nevis.”



Nothing could be clearer than that except the motives of PAM and exactly why they are hell-bent on
destroying the peace, tranquility and reputation of this country.



A judgment, several judgments in fact, have been handed down by the Courts regarding the numerous
injunctions. Ordinary people are confused about what they are, what they mean and what
consequences will follow. Then there are Appeals, not just those in the courts but from citizens
appealing for clarity and for a stop to this nonsense. They’re appealing for help to stop the PAM
nonsense, re-elect their beloved Labour Party and ensure continuity of representation during this crucial
period when the world is in the grip of a global financial crisis that is unprecedented in scope and
severity.



There seems to be an attempt to create an elaborate smokescreen where PAM is hiding behind a
barrage of injunctions to cover-up and distract attention from something. Many people believe it is the
matter of citizenship – have they or haven’t they renounced their foreign citizenship? This foreign
citizen business is one ship that is sinking. In fact, when the ship hit the fan, the sinking and stinking
start one time.



So what next? How many more injunctions will come to mask the scent of something unpalatable and
obnoxious? How much longer must the people of St Kitts/Nevis wait for the elections? How much
longer must the international community wait to deal with the legally elected Government which has a
long history and track record of excellence but are now tied down by legal red tape and their freedom
to act is hampered unnecessarily by people with money to waste. If they’re wasting their money and
their financers’ money like that what would they do with yours when they’re in charge of your
Treasury?
Right now this country is not at a junction or injunction but a particular juncture in our history. Do we
have the continuity that we need to survive the next five years of uncertainty in a global economy that
is already negatively affecting our own lives and livelihoods, or do we continue to be Injunction City
where every Tom, Dick and Harry can undermine our fragile democracy for the most trivial and
transparent reasons?
