2. Relevant Experience
Robert has been principally a contentious construction lawyer involved in a wide range of
disputes and forms of contract. Particular areas of expertise include mechanical and
electrical engineering and, more generally, measurement and quantum disputes. Robert
has experience of professional negligence claims for and against construction
professionals.
Robert’s scientific (academic) background and longstanding family involvement in the
building trade provides an instinctive feel for and familiarity with technical aspects of
construction.
Extensive experience of adjudication as a representative, adjudicator and advocate/
solicitor in many adjudication enforcement disputes (four of which have reached the
Court of Appeal).
Profound knowledge of contract law with wide experience of representation and
advocacy at various levels, involving property, planning, construction, insolvency and
other disputes. The disputes being resolved variously by arbitration, expert referral,
various court procedures, mediation, as well as adjudication.
Robert also has experience of insolvency, though largely related to construction and
development.
Robert undertakes non litigious work related to scrutinizing/drafting construction
contracts inclusive of consultant appointments, bonds, warranties, novation agreements,
etc.
Robert has a particular strength in the area of party wall work where experience gained
under the London Building Acts, that predates the legislation of the late 1990s, is of
value. This is often combined with other aspects of neighbourly relations and advice
relating to Town & Country planning.
Robert has also undertaken property dispute work related to development
agreements/projects including help in structuring non contentious solutions.
Now limited to more occasional appearances Robert has appeared as advocate in cases
before the Technology and Construction Court, Chancery Division, Companies Court and
of course the County Court. Nonetheless Robert is supportive of our split profession with
professional advocacy the specialism of the Bar.
Personal
Robert still maintains his links with the Mid Wales family farm where he was brought up
and has interests in: ornithology/natural world, sailing and rugby union.
