SUBJECT-CONSTITUTION OF INDIA(COI)
TOPIC-IMPORTANT AMENDMENTS ON COI
Guided by- Prof.Dr.U.J Kahalekar
AMENDNENT IN INDIA
The Indian Constitution is both flexible and rigid as some parts of
the constitution can be amended by ordinary legislation while the
other parts can be amended only by the process given in Article
368.
Artical 368-Article 368 of the constitution provides for the
procedure for amendment to constitution.
IMPORTANT AMENDMENTS ON COI
1st Amendment Act,1951—
• The concept of ‘special protection’ or ‘positive discrimination’
was introduced to enable reservation.
• It amended Article 19 (2) and introduced seven grounds except
‘sovereignty and integrity of India’[2] on which the right to
freedom of speech and expression can be restricted.
• The Ninth Schedule was added
24th Amendment Act,1971— It was amended in order to overide
the Golakhnath case judgement.
• The President’s assent to Constitutional Amendment Bill was
made compulsory.
42nd Amendment Act,1976— Since the 42nd Amendment Act is
the most comprehensive amendment of the Indian Constitution,
called the ‘Mini-Constitution,’
• It was proposed to amend the constitution to spell out expressly
the high ideals of socialism, secularism and the integrity of the
nation, to make the directive principles more comprehensive
and give them precedence over those fundamental rights which
have been allowed to be relied upon to frustrate socio-economic
reforms for implementing the directive principles.
73rd Amendment Act,1992—
• Panchayati Raj institutions were given constitutional status.
• A new Part-IX and 11th Schedule were added in the Indian
Constitution to recognize Panchayati Raj Institutions and
provisions related to them.
74th Amendment Act,1994—
• Urban local bodies were granted constitutional status
• A new Part IX-A and 12th Schedule were added to the
Indian Constitution
100th Amendment Act,2015—
• To pursue land boundary agreement 1974 between India
and Bangladesh, exchange of some enclave territories with
Bangladesh mentioned
• Provisions relating to the territories of four states (Assam,
West Bengal, Meghalaya) in the first schedule of the Indian
Constitution, amended.
101st Amendment Act,2016—
• Goods and Service Tax (GST) was introduced.
