DETERMINATION OF RIGHT AND DUTIES OF PARTNERS AND AGREEMENT IN RESTRAINT OF TRADE
 Determined by contract  Contract may be express or implied by course of dealing  Contract may be varied by consent of all partners  Consent may be express or implied by course of dealing Section -11(1)
 A partner shall not carry on the business other than that of the firm while he is a partner  Constitutional Provision Article- 18 State can by law ban or declare any trade unlawful- PLD1975 S.C. 667 Section – 11(2)
