Taking Over
Management from
Your Agent
Checking the agent’s terms for terminating the
business agreement is an excellent first step.
CAN YOU ISSUE YOUR TENANCY
AGREEMENT?
Once you’ve had notice served, you will need to
let the tenants know there has been a change in
management.
The existing tenancy agreement issued by the
agent may still be valid whenever you take
control of management.
The tenants will also need to stop paying their
rent via your former agent, so you should instruct
them to cancel their standing order or direct
debit following their final payment.
You need to arrange to collect all the property
keys from your former agent, alongside any
relevant information relating to the tenancy.
Before you proceed, you should
consider a few things. You can
issue new tenancy agreements,
but you don’t need to since the
tenancy can continue on the
same terms, though you can also
update the contact details
through a Section 48 notice. It
makes more sense to
offeIssuing a new agreement is
not simply an extension of the
original agreement with your
agent; you need to create a
brand new tenancy agreement.
