Korina Garcia wrote a letter to Professor Michael Hulldrums regarding a slanderous Facebook post. The post said "Smartille is a NAZI and making student’s lives miserable". Garcia states that while Facebook is protected by free speech, the post violates Hulldrums' teaching contract and New York's deformation law. Garcia demands that Hulldrums remove the post, apologize to Smartille with Garcia present within 10 business days or legal action will be taken.

Dear Mr. Hulldrums:
On June 2nd, 2013, it was brought to my attention that you
posted a slanderous comment on the social network Facebook that
said “Smartille is a NAZI and making student’s lives miserable”.
It is to my knowledge that although the social network,
Facebook, is protected by the first amendment, but you have
violated your teacher employment contract and the New York
deformation law. Under the New York Deformation Law the claims
are:a false statement, anything published to a third party
without privilege or authorization and with fault amounting to
at least negligence.You have showed violation to all these
claims. Also, in your contract it says that teachers are not
allowed to use any social networking to slander any students or
other fellow teachers.
By posting this update that was found on your personal
Facebook for the public to see and having this evidence of your
violation printed out in front of me; my client Mr. Smartille
and I demand that you remove this comment off your Facebook
account and confront him with an apology with me present.
If you do not abide by these demands within 10 business
days, you will be served with a complaint.
