5. Our #1 Question From Entrepreneurs.
Everyone wants to know “How do I get a
patent?”
But before you get a patent, you need to start with:
How to Apply for a Patent!
6. This means that you need to
understand the patent process
What you need to know to get a patent
1. Can I even get a patent?
2. Has someone else already thought of my idea?
3. What do I need to include in my patent?
4. What do I do with my patent application?
5. How long will it take me to finally get a patent?
8. Is your idea in a patentable category?
1.Software and hardware are patentable
categories.
Movies, books, names, pictures and logos
are not patentable categories
9. Did you publish your idea?
1. Publishing your idea more than 1 year
ago blocks you from getting a US
patent.
2. Publishing your idea at any time
blocks you outside the US.
3. “Publishing” means you’ve publicly
released your app.
11. STAGE 2 - Has
Someone Else
Already Patented
My Idea?
12. Are you first to think of your idea?
We recommend Google Patents for a
quick and easy keyword search!
Enter the words for what you want to
find, just like a regular Google search.
13. Protip - search patents and more!
Check the box marked “include non-
patent literature” to search both
patents and other publications!
(very important)
14. You can search for your competitor’s
patents.
Search using Advanced Google Patent Search
Your
competitor’s
name here
15. STAGE 3 - What do
I need to include in
my patent?
16. First you need great drawings
Drawings tell the story of your idea.
For software, we recommend at least
7-10 drawings, including system and
method drawings.
17. Want to get your drawings from
whiteboard to patent drawings?
Click here to get our free e-book, “From Whiteboard
to Patent Drawings - You’re More Than Halfway
There”
18. Second you need great text.
● Your text tells the story of your drawings.
● So each feature of your idea has to be in
your text.
Protip: Use this as an opportunity to
double-check that each feature of
your idea is in your drawings also.
20. You need to file it at the USPTO.
The USPTO is the US Patent and
Trademark Office.
You can file your patent application
electronically or by regular US mail (no
email or fax, please!).
21. Filing = Applying for a Patent
By filing your patent application at the
USPTO, you are applying for a patent.
There are detailed procedures for
filing your patent application -
depending on the type of patent etc.
23. We can help you get your patent
application filed!
Because the patent filing process is
complicated, we have free office hours to
answer your questions.

24. STAGE 5 - How long
will it take to get a
patent?
25. Short answer: it depends
Long answer - at least 2-3 years,
depending on the backlog at the
USPTO
You can make the process go faster
by filing a really good patent
application after lots of patent
searches.
26. BEFORE YOU ARE ISSUED A PATENT
Patent pending – mark your website/app
Your application is property
As long as you file first, you can block others
from getting a patent
