This document summarizes several sections of the Illinois Criminal Code relating to criminal trespassing. It defines criminal trespassing to include knowingly entering or remaining in vehicles, buildings, land, government property, airports, nuclear facilities, and places of public amusement without permission. publicduringitsnormal hoursof operation;norshall thisSectionapplytoa personwhoentersa public
buildingunderthe reasonable beliefthatthe buildingisstillopentothe public.
(a-5) Exceptas otherwise providedinthissubsection,whoeverentersuponanyof the followingareasin
or on a motor vehicle (includinganoff-roadvehicle,motorcycle,moped,oranyotherpoweredtwo-
wheel vehicle) afterreceiving,priortothatentry,notice fromthe owneror occupant thatthe entryis
forbiddenorremainsuponorinthe areaafter receivingnoticefromthe owneroroccupantto depart
commitsa ClassA misdemeanor:
(1) A fieldthatisusedfor growingcropsor that is capable of beingusedforgrowingcrops.
(2) Anenclosedareacontaininglivestock.
(3) Anorchard.
(4) A barn or otheragricultural buildingcontaininglivestock.
(b) A personhasreceivednotice fromthe owneroroccupantwithinthe meaningof Subsection(a) if he
has beennotifiedpersonally,eitherorallyorinwritingincludingavalidcourtorder as definedby
subsection(7) of Section112A-3 of the Code of Criminal Procedure of 1963 grantingremedy(2) of
subsection(b) of Section112A-14 of that Code,or if a printedor writtennotice forbiddingsuchentry
has beenconspicuouslypostedorexhibited atthe mainentrance tosuch landor the forbiddenpart
thereof.
3. (c) This Sectiondoesnotapplytoany person,whetheramigrantworkerorotherwise,livingonthe land
withpermissionof the ownerorof hisagenthavingapparentauthoritytohire workersonsuch landand
assignthemlivingquartersora place of accommodationsforlivingthereon,nortoanyone livingon
such landat the requestof,or byoccupancy, leasingorotheragreementorarrangementwiththe
owneror hisagent,nor to anyone invitedbysuchmigrantworkeror otherpersonsolivingonsuchland
to visithimat the place he is solivinguponthe land.
(d) A personshall be exemptfromprosecutionunderthisSectionif he beautifiesunoccupiedand
abandonedresidential andindustrialpropertieslocatedwithinanymunicipality.Forthe purpose of this
subsection,"unoccupiedandabandonedresidential andindustrial property"meansanyreal estate (1) in
whichthe taxeshave notbeenpaidfora periodof at least2 years;and (2) whichhasbeenleft
unoccupiedandabandonedforaperiodof at leastone year; and"beautifies"meanstolandscape,clean
up litter,orto repairdilapidatedconditionsonorto boardup windowsanddoors.
(e) Nopersonshall be liable inanycivil actionformoneydamagestothe ownerof unoccupiedand
abandonedresidential andindustrialpropertywhichthatpersonbeautifiespursuanttosubsection(d)of
thisSection.
(f) ThisSectiondoesnotprohibitapersonfromenteringabuildingoruponthe landof anotherfor
emergencypurposes.Forpurposesof thissubsection(f),"emergency"meansaconditionor
circumstance inwhichan individual isorisreasonablybelievedbythe persontobe inimminentdanger
of seriousbodilyharmorin whichpropertyisor isreasonablybelievedtobe inimminentdangerof
damage or destruction.
(g) Paragraph (3.5) of subsection(a) doesnotapplytoa peace officerorotherofficial of a unitof
governmentwhoentersabuildingorlandinthe performance of hisor herofficial duties.
4. (h) A personmaybe liable inanycivil actionformoneydamagestothe ownerof the landhe or she
entereduponwithamotor vehicle asprohibitedundersubsection(a-5) of thisSection.A personmay
alsobe liable tothe ownerforcourt costsand reasonable attorney'sfees.The measure of damagesshall
be:(i) the actual damages,butnotlessthan $250, if the vehicle isoperatedinanature preserve or
registeredareaasdefinedinSections3.11 and3.14 of the IllinoisNatural AreasPreservationAct;(ii)
twice the actual damagesif the ownerhaspreviouslynotifiedthe persontocease trespassing;or(iii)in
any othercase,the actual damages,butnot lessthan$50. If the personoperatingthe vehicle isunder
the age of 16, the ownerof the vehicle andthe parentorlegal guardianof the minorare jointlyand
severallyliable.Forthe purposesof thissubsection(h):"Land"includes,butisnotlimitedto,landused
for crop land,fallowland,orchard,pasture,feedlot,timberland, prairie land,mine spoilnature
preservesandregisteredareas."Land"doesnotinclude drivewaysorprivate roadwaysuponwhichthe
ownerallowsthe publictodrive.
"Owner"meansthe personwhohasthe right to possessionof the land,includingthe owner,operatoror
tenant.
"Vehicle"hasthe same meaningasprovidedunderSection1-217of the IllinoisVehicle Code.(Source:

Sec.21-4. Criminal Damage toGovernmentSupportedProperty.
(720 ILCS 5/21-4)
(1) Anyof the followingactsisa Class4 felonywhenthe damage topropertyis$500 or less,andany
such act is a Class3 felonywhenthe damage topropertyexceeds$500 but doesnotexceed$10,000; a
Class2 felonywhenthe damage topropertyexceeds$10,000 but doesnot exceed$100,000 and a Class
1 felonywhenthe damage topropertyexceeds$100,000:
(a) Knowinglydamagesanypropertysupportedinwholeorinpart withState funds,fundsof a unitof
local governmentorschool district,orFederal fundsadministeredorgrantedthroughState agencies
withoutthe consentof the State;or
5. (b) Knowingly,bymeansof fire orexplosive damagespropertysupportedinwhole orinpartwithState
funds,funds of a unitof local governmentorschool district,orFederal fundsadministeredorgranted
throughState agencies;or
(c) Knowinglystartsafire on propertysupportedinwhole orinpartwithState funds,fundsof a unitof
local governmentorschool district,orFederal fundsadministeredorgrantedthroughState agencies
withoutthe consentof the State;or
(d) Knowinglydepositsonlandorin a buildingsupportedinwhole orinpartwithState funds,fundsof a
unitof local governmentorschool district,orFederal fundsadministeredorgrantedthroughState
agencieswithoutthe consentof the State,anystinkbomborany offensive smellingcompoundand
therebyintendstointerfere withthe use byanotherof the landor building.
(2) Whenthe damage to propertyexceeds$10,000, the court shall impose uponthe offenderafine

Sec.21-5. Criminal TrespasstoState SupportedLand.
(720 ILCS 5/21-5)
(a) Whoeverentersuponlandsupportedinwholeorinpart withState funds,or Federal funds
administeredorgrantedthroughState agenciesorany buildingonsuchland,afterreceiving,priorto
such entry,notice fromthe State or itsrepresentative thatsuch entryisforbidden,orremainsupon
such landor insuch buildingafterreceivingnotice fromthe State oritsrepresentativetodepart,and
whotherebyinterfereswithanotherperson'slawful use orenjoymentof suchbuildingorland,commits
a ClassA misdemeanor.
6. (b) A personhasreceivednotice fromthe State withinthe meaningof subsection(a) if he hasbeen
notifiedpersonally,eitherorallyorinwriting,orif a printedor writtennotice forbiddingsuchentryto
himor a groupof whichhe isa part,has beenconspicuouslypostedorexhibitedatthe mainentrance to
such landor the forbiddenpartthereof.(c) Whoeverentersuponlandsupportedinwhole orinpart
withState funds,or federal fundsadministeredorgrantedthroughState agenciesor anybuildingon
such landbypresentingfalse documentsorfalselyrepresentinghisorheridentityorallytothe State or
itsrepresentative inordertoobtainpermissionfromthe State orits representativetoenterthe building
or land;or remainsupon such landor insuch buildingbypresentingfalse documentsorfalsely
representinghisorheridentityorallytothe State or itsrepresentative inordertoremainuponsuch
landor in suchbuilding,andwhotherebyinterfereswithanotherperson'slawful use orenjoymentof
such buildingorland,commitsaClassA misdemeanor.Subsection(c) doesnotapplytoa peace officer
or otherofficial of aunit of governmentwhoentersuponlandsupportedinwhole orinpartwithState
funds,orfederal fundsadministeredorgrantedthroughState agenciesoranybuildingonsuchlandin

Sec.21-6. UnauthorizedPossessionorStorage of Weapons.

(a) WhoeverpossessesorstoresanyweaponenumeratedinSection33A-1inany buildingoronland
supportedinwhole orinpart withpublicfundsorinany buildingonsuchlandwithoutpriorwritten
permissionfromthe chief securityofficerforsuchlandor buildingcommitsaClassA misdemeanor.
(b) The chief securityofficermustgrantanyreasonable requestforpermissionunderparagraph(a).

7. (a) Whoeverentersupon,orremainsin,anyrestrictedareaor restrictedlandingareausedin
connectionwithanairportfacility,or part thereof,inthisState,aftersuchpersonhasreceivednotice
fromthe airportauthoritythatsuch entryisforbiddencommitsaClass4 felony.(b) Whoeverenters
upon,or remainsin,anyrestrictedareaor restrictedlandingareausedinconnectionwithanairport
facility,orpart thereof,inthisState,while inpossessionof aweapon,replicaof aweapon,or
ammunition,afterthe personhasreceivednotice fromthe airportauthoritythatthe entryisforbidden
commitsa Class3 felony.(c) Notice thatthe areais"restricted"andentrythereto"forbidden",for
purposesof thisSection,meansthatthe personorpersonshave beennotifiedpersonally,eitherorally
or in writing,orbya printedorwrittennotice forbiddingsuchentrytohimor a group or an organization
of whichhe isa member,whichhasbeenconspicuouslypostedorexhibitedateveryusable entrance to
such areaor the forbiddenpartthereof.
(d) Whoeverentersupon,orremainsin,anyrestrictedareaor restrictedlandingareaused in
connectionwithanairportfacility,orpart thereof,inthisState bypresentingfalse documentsorfalsely
representinghisorheridentityorallytothe airportauthoritycommitsaClassA misdemeanor.
(e) Whoeverentersupon,orremainsin,any restrictedareaorrestrictedlandingareaasprohibitedin
subsection(a) of thisSection,while dressedinthe uniformof,improperlywearingthe identificationof,
presentingfalsecredentialsof,orotherwise physicallyimpersonatinganairman,employee of anairline,
employeeof anairport,or contractor at an airport commitsa Class4 felony.
(f) The terms"Restrictedarea"or "Restrictedlandingarea"inthisSectionare definedtoincorporate the
meaningascribedtothose termsinSection8 of the "IllinoisAeronauticsAct",approvedJuly24,1945, as
amended,andalsoinclude anyotherareaof the airport that hasbeendesignatedsuchbythe airport
authority.
The terms "airman"and"airport"in thisSectionare definedtoincorporate the meaningascribedto
those termsinSections6 and 12 of the IllinoisAeronauticsAct.
8. (g) Subsection(d) doesnotapplytoa peace officerorotherofficial of aunitof governmentwhoentersa
restrictedareaor a restrictedlandingareausedinconnectionwithanairportfacility,orpartthereof,in

Sec.21-8. Criminal trespasstoa nuclearfacility.

(a) A personcommitsthe offense of criminaltrespasstoanuclearfacilityif he orshe knowinglyand
withoutlawful authority:
(1) entersorremainswithinanuclearfacilityoronthe groundsof a nuclearfacility,afterreceiving
notice before entrythatentrytothe nuclearfacilityisforbidden;or
(2) remainswithinthe facilityoronthe groundsof the facilityafterreceivingnotice fromthe owneror
managerof the facilityorotherpersonauthorizedbythe ownerormanagerof the facilitytogive that
notice to departfromthe facilityorgroundsof the facility;or
(3) entersorremainswithinanuclearfacilityoronthe groundsof a nuclearfacility,bypresentingfalse
documentsorfalselyrepresentinghisorheridentityorallytothe ownerormanagerof the facility.This
paragraph (3) doesnot applyto a peace officerorotherofficial of aunitof governmentwhoentersor
remainsinthe facilityinthe performance of hisorherofficial duties.
(b) A personhasreceivednotice fromthe ownerormanagerof the facilityorotherpersonauthorized
by the owneror managerof the facilitywithinthe meaningof paragraphs(1) and (2) of subsection(a) if
he or she hasbeennotifiedpersonally,eitherorallyorinwriting,orif a printedorwrittennotice
forbiddingthe entryhasbeenconspicuouslypostedorexhibitedatthe mainentrance tothe facilityor
groundsof the facilityorthe forbiddenpartof the facility.
9. (c) In thisSection,"nuclearfacility"hasthe meaningascribedtoitinSection3 of the IllinoisNuclear
SafetyPreparednessAct.

Sec.21-9. Criminal trespasstoa place of publicamusement.
(720 ILCS 5/21-9)
(a) A personcommitsthe offense of criminaltrespasstoaplace of publicamusementif he orshe
knowinglyandwithoutlawful authorityentersorremainsonanyportionof a place of public
amusementafterhavingreceivednotice thatthe general publicisrestrictedfromaccesstothat portion
of the place of publicamusement.Suchareasmayinclude,butare notlimitedto:aplayingfield,an
athleticsurface,astage,a lockerroom,or a dressingroomlocatedatthe place of publicamusement.(a-
5) A personcommitsthe offense of criminaltrespasstoaplace of publicamusementif he orshe
knowinglyandwithoutlawful authoritygainsaccesstoor remainsonany portionof a place of public
amusementbypresentingfalsedocumentsorfalselyrepresentinghisorheridentityorallytothe
propertyowner,alessee,anagentof eitherthe ownerorlessee,oraperformerorparticipant.This
subsection(a-5) doesnotapplytoa peace officerorotherofficial of a unitof governmentwhoentersor
remainsinthe place of publicamusementinthe performance of hisorherofficial duties.
(b) A propertyowner,alessee,anagentof eitherthe ownerorlessee,ora performerorparticipantmay
use reasonable force torestraina trespasserandremove himorherfrom the restrictedarea;however,
any use of force beyondreasonable force maysubjectthatpersontoanyapplicable criminal penalty.
(c) A personhas receivednoticewithinthe meaningof subsection(a) if he orshe hasbeen notified
personally,eitherorallyorinwriting,orif a printedor writtennotice forbiddingsuchentryhasbeen
conspicuouslypostedorexhibitedatthe entrance tothe portionof the place of publicamusementthat
10. isrestrictedor an oral warninghas beenbroadcastoverthe publicaddresssystemof the place of public
amusement.
(d) In thisSection,"place of publicamusement"meansastadium, atheater,or any otherfacilityof any
kind,whetherlicensedornot,where alive performance,asporting event,oranyotheractivitytakes
place for otherentertainmentandwhere accesstothe facilityismade available tothe public,regardless
of whetheradmissionischarged.
(e) Sentence.Criminal trespasstoaplace of publicamusementisaClass4 felony.Uponimpositionof
any sentence,the courtshall alsoimpose afine of notlessthan$1,000. In addition,anyorderof
probationor conditional discharge enteredfollowingaconvictionshall include aconditionthatthe
offenderperformpublicorcommunityservice of notlessthan30 and notmore than 120 hours,if
communityservice isavailable inthe jurisdictionandisfundedandapprovedbythe countyboardof the
countywhere the offenderwasconvicted.The courtmayalso impose anyotherconditionof probation
