Agrifina Daniel Garcia filed an adverse claim against the registered land title of Norman D. Cabling. Garcia claims to be the real owner of the land according to her own land title. She asserts her signatures were forged on the Deed of Absolute Sale transferring the land to Cabling. Garcia requests the Register of Deeds to register her adverse claim to prevent Cabling from transferring the land to an innocent third party, which would make reconveyance to her impossible. Garcia contracted a lawyer to demand restitution of the land.

I, AGRIFINA DANIEL GARCIA, of legal age, Filipino, married to Roberto Garcia, after
being duly sworn to in accordance with law, do hereby depose and state:
1. That I have an adverse claim in that certain registered parcel of land now registered in the
name of NORMAN D. CABLING, married to Cristina H. Banting (Annex “A”), more
particularly described as follows:

Bounded on the NE., along line 1-2 by Lot 2513-A-3 of the subd. plan, on the SE., along
line 2-3-4 by Sapang Mayapyap, on the SW., along line 4-5 by Lot 2513-A-5, on the
NW., along line 5-6 by Lot 2513-A-1, along line 6-1 by Lot 2513-A-2, all of the subd.
plan. Beginning at a point marked “1” on plan, being S. 11 deg. 48’E, 636.32 m. from
LM 31, Cabanatuan Cad.; thence S. 59 deg. 27’E., 289.60 m. to point 2; S. 15 deg.
24’W., 16.65 m. to point 3; S. 40 deg. 17’W., 7.17 m. to point 4; N. 58 deg. 35’W.,
291.93 m. to point 5; N. 31 deg. 05’E., 12.00 m. to point 6; N. 31 deg. 07’E., 6.60 m. to
the point of beginning; containing an area of SIX THOUSAND AND EIGHTY SIX
(6,086) SQUARE METERS.
2. That I am the real owner of the parcel of land described above as per attached Transfer of
Certificate of Title T-46649 marked herein as Annex “B”;
3. That my adverse claim consists of right of ownership over the whole property identified
above because the purported Deed of Absolute Sale marked herein as Annex “C ” not
having been signed by me and my husband as our signatures were forged;
4. That said registered owner may try to transfer to an innocent third party the ownership of
said parcel of land which will make reconveyance to me impossible anymore;
5. That I have contracted a lawyer to demand restitution.
6. That I am presently residing at 156 Brgy. Lourdes, Sta. Rosa, Nueva Ecija which all
notices may be served upon me.
WHEREFORE, I hereby request the Register of Deeds of Nueva Ecija, Cabanatuan City
to register these adverse claim in the manner provided by law.
