OUR SOLUTION
Any self-employed contractor, who falls under the definition "supervision, direction or control"
may be able to continue to be self-employed, but have Tax and National Insurance calculated
on account on all deemed employment income, we are also able to offset any genuine business
expenses on this employed income which in turn reduces the amount of Tax and NIC deduct on
account.
We are preparing further information which will explain what the new legislation will mean for
you and offering the opportunity for you to provide any information which supports your tax
status.
If you are an agency currently payroll a number of self-employed workers or using the CIS
scheme and have no alternatives to be compliant with the new Agency legislation chapter 7
policy.
NEW LEGISLATION
Assured Contractors Self Employed & CIS Hybrid scheme was born because of the changes to the
taxation of self-employed contractors announced by the Government on 10th December 2013 by way of
a consultation document, the outcome of which was published on 13th
March 2014.
As a self-employed subcontractor you may be affected by new legislation brought in by the Government
to tackle what they are calling “false self-employment through onshore intermediaries”. This legislation
states that if you are under the direct control or supervision of an individual in your hirer, there is a
statutory requirement to deduct PAYE and National Insurance Contributions (NIC’s) from any payment
due to you.
These changes have now been confirmed, and under the new rules, it is likely that you no longer meet
HMRC’s criteria for being HMRC’s criteria for being taxed as self-employed. This is because you are
inevitably subject to some degree of control or supervision with respect to how you do your job.
