process, a process conducted by each employer in Romania each
month these kind of payments are made on the payroll.
The process is a time consuming and highly documented one, also

become valid for medical leave amounts recovery.

Thus, according to OUG 158/2005 provisions, all amounts
representing medical leave remuneration paid in the name of the
budget of the National Social Health Insurance (FNUASS) are
deducted as follows:
Deducted by the company from its monthly contributions
for leaves and indemnities due for that month.
(percentage of the contributions is 0,85% applied to gross
stock)
If any amounts are yet to be recovered, the company will
start recovery process from FNUASS, using a “recovery of
medical amounts file”. The file together with all annexes
must deposited to the Health Insurance House within
maximum of 90 calendar days since the company is
entitled to recover the amounts.

The file structure should be:
o A written request (template Annex. 12 rules of the OUG 158/2005)
o Centralized report of sick leave certificates (template Annex. 18
rules for applying the EGO 158/2005)
o Copy of 112 Tax Return for the exact month the company is
drafting the request (Annex 1 and Annex 1.1_Company)
o Filled in medical leave certificates (2 copies -pink), for the month
the company is drafting the request
o Detailed report containing status of medical leave indemnities - it
is obtained from the IRS (Account 439).

Even if the deadline for receiving an answer
from authorities is 30 calendar days, often
this kind of files usually end up blocked
somewhere inside of the process and unless
no proper actions are taken, the percentage
of recovered amounts by the company can
be 0%.

Insurance House in order to make sure your
file has “to be solved “status.
