31. ICMR Guidelines for Surrogacy
Surrogate should be citizen and resident of India
Surrogate Mother should be between 21 to 35 years in age
A surrogate mother shall not act as an oocyte donor for the couple
or individual
A ART Clinic should NOT consider conception by surrogacy for
patients for whom it would normally be possible to carry a baby to
term.
No woman shall act as a surrogate for more than 5 successful live
births in her life, including her own children.

No surrogate mother shall undergo embryo transfer more than
three times for the same couple.
Birth certificate of a baby born through surrogacy should bear name
of the commissioning parents
Commissioning Parents shall be legally bound to accept the custody
of the child / children born through surrogacy irrespective of any
abnormality that the child / children may have, and the refusal to do
so shall constitute an offence under this Act.

In the case of a relative acting as a surrogate, the relative should
belong to the same generation as the women desiring the
Surrogate.
A couple or an individual shall not have the service of more than
one surrogate at any given time.
A couple shall not have simultaneous Transfer of embryos in the
woman and in a surrogate.
34. Selection Criteria for Surrogate Mother’s
If married needs to have consent of her husband
A surrogate mother shall be medically tested for such diseases, sexually
transmitted and all other communicable diseases which may endanger the
health of the child
She must declare in writing that she has not received a blood transfusion or a
blood product in the last six months
35. Typical Breakup of Payout to Surrogate
• 1st instalment which will not be less than 5%
• 2nd instalment which will not be less than 5%, when she becomes
pregnant.
• 3rd instalment of 5% at the end of first trimester.
• 4th instalment of 10% at the end of the second trimester.
• 5th instalment of 75% just after delivery.
The above charges are for the first embryo transfer for the patient. If that does
not succeed, for each subsequent embryo transfer within six months of the
first embryo transfer, the surrogate will receive (in addition to the payment
already made) 50% of the total price agreed to initially, in a similar fashion as
above.
