2. The Ombudsman ensures that human rights and
freedoms are respected by public authorities,
organizations and businesses, as well as by
persons at all levels with positions of
responsibility.
Working with the Ombudsman is the Children’s
Ombudsman, a specialized advocate for ensuring
the respect for children’s rights and freedoms and
for enforcing the provisions of the UN Convention
on the Rights of the Child.

3. The Ombudsman’s Office receives and
examines complaints about human rights
violations. At the same time, people can
obtain an audience with the
Ombudsman’s Office both in its Main
Office in Chisinau and in its four local
representative offices, located in Balti,
Cahul, Comrat and Varnita.

Confirming adherence to the Universal Declaration
of Human Rights, to the European Convention for
the Protection of Human Rights and Fundamental
Freedoms, to other international legal acts
regarding human rights and considering that, in
accordance with the UN Charter, the state
stimulates respect for human rights and freedoms
and ensures the protection of the rights and
freedoms of all natural persons on the territory of
the Republic of Moldova.
5. Examining requests for human rights violations;
Improving the legislation in the field of human rights;
Recommendations for ratification and accession to
international instruments in the fieldhuman rights;
Referral to the Constitutional Court;
Amicable settlement of conflicts between authorities
and natural persons;

6. a) is a citizen of the Republic of Moldova;
b) is not subject to a judicial protection measure in the form of
guardianship;
c) holds a bachelor's degree or its equivalent;
d) has a working experience of at least 10 years and a notorious
activity in the field of defense and promotion of human rights;
e) enjoys an impeccable reputation;
f) knows the state language;
g) does not have, in the past 5 years, in the professional integrity
file, entries regarding the negative result of the professional
integrity test for violating the obligation provided for in art. 7
para. (2) lit. a) from Law no. 325 of December 23, 2013 regarding
the evaluation of institutional integrity.
7. a) has a criminal record, including
expungements, for the intentional commission
of a crime or has been absolved of criminal
liability through an act of amnesty or pardon;
b) was fired or released from office for
imputable reasons;
c) is prohibited from occupying a public
position or public dignity, which derives from
a finding of the National Integrity Authority.

9. Article7-(1) Upon taking office, the People's Advocate takes the
following oath in the plenary session of the Parliament: "I swear to
respect the Constitution and laws of the Republic of Moldova, the
statute of the People's Advocate, to defend the fundamental rights
and freedoms of the person/child, to fulfill my obligations in good
faith and impartiality attributions, to defend the dignity of the
People's Advocate Institution".
(2)-Refusal to take the oath prevents the People's Advocate from
taking office and opens the procedure for selecting and appointing
another person.
10. In exercising his mandate, the People's Advocate has the right:
a) to be received in audience by the President of the Republic of Moldova,
by the Speaker of the Parliament and by the Prime Minister both within
the audience hours and outside of them;
b) to be received immediately and without any form of obstruction or
delay in the audience by leaders and other persons with responsible
positions of all levels of public authorities, institutions, organizations and
enterprises, regardless of the type of property and the legal form of
organization, of police inspectorates and detention facilities within them,
of penitentiary institutions, criminal detention facilities, military units,
placement centers for immigrants or asylum seekers, of institutions that
provide social, medical or psychiatric assistance, of special educational
institutions and re-education or curative and re-education institutions for
minors and other similar institutions;
c) to attend and speak at the meetings of the Parliament, of the
Government, of the Constitutional Court, of the Superior Council of
Magistracy, of the Superior Council of Prosecutors;
d) to submit recommendations to the Parliament or the Government in
order to improve the legislation in the field of ensuring human rights and
freedoms;
11. (1) The People's Advocate is obliged to:
a) to defend human rights and freedoms in accordance with the
Constitution of the Republic of Moldova, with international laws
and treaties in the field of human rights and freedoms to which
the Republic of Moldova is a party, to exercise the duties of the
position in accordance with the legislation;
b) not to divulge state secrets and other information and data
protected by law;
c) not to divulge confidential information, as well as personal data
communicated to him in the course of his activity, except with the
consent of the person to whom they refer;
d) to refrain from any actions inconsistent with the status he
holds.
(2) Upon entering office, and thereafter every year, the People's
Advocate shall submit, in accordance with the law, the declaration
of assets and personal interests.
