Urbtech NPX Buyers has formed an Association to fight against the builder's (Urbtech India Pvt. Ltd, and Hi-lead Infotech Pvt. Ltd.) anomalies and take action against them at appropriate authorities, forums and media.
2. NPX TOWER OWNERS
ASSOCIATION
(A Buyers Welfare Association registered under
Society Registration Act 1860 and UP
Apartment Act 2010, Registration # 034036)
4. Objective :
To make aware the buyers & fight jointly
against the anomalies of the builder, We as an
Association wish to find a long-term amicable
solutions between Builder and Buyers of
Urbtech NPX Project as per Uttar Pradesh
Apartment (Promotion of Construction,
Ownership and Maintenance) Act, 2010 (U.P. Act
no. 16 of 2010).
5. List of NPX Buyer’s Grievances :
• Cancellation of Plot from Noida Authority
Noida Authority has cancelled this project due to
misrepresentation of facts by the Company, Hi Lead
Infotech P. Ltd, whilst most of the buyers have
already paid 95-100% of the cost of their units.
• No Replies/Communications from the
Company (Hi-Lead Infotech/ Urbtech India)
Buyers are disparately calling & writing to the builder
but no proper response is given by the builder.
6. • Penalty for delay in Handing over of the Units
The most NPX buyers are mostly end users and not able to
start their business as they have not got the possession of
their units and suffering losses on account of opportunity
cost and the rental cost of present business accommodation.
Some of us are also paying interest on the loans taken for
purchase of their units. On the other hand builder has
charged 24% interest on the delayed payment, should we not
get the compensation same rate?
• Unjustified Interests and Charges
Most of the letters the buyers have received are
unsigned, some undated and even backdated. The
Statement of Accounts issued by your company is full of
flaws mentioning baseless charges/ unjustified higher
rate of interest. “Statement of Accounts” are on plain
paper and unsigned with unjustified interest and other
charges.
7. • Measurement of Units
They have measured the area of pillar, tow wall area,
measured the area from outer glass and charged
inflated & imaginary area, which actually not exist.
We say that the measurement of units are not as not
as per prevalent laws/bye-laws such as NBC, NOIDA
Bye-Laws etc.
• Change of Location without Permission
They have arbitrarily/unilaterally changed the
locations/floors of the unit without the consent of
the buyers. This has unnecessarily created confusion
and raised discontentment in the minds of buyers.
8. • Assured Return & Credit Notes
Some section of the buyers had invested in this category and they
have not honored their commitments in these regard.
• Capital Replacement Charges & IFMS Charges Maintenance
Agreement
These charges fall under the category of maintenance /
upkeep of the building/ premises. As per “UP Apartment Act
2010” under sub section (2), sub section (5), the
management of the affairs of the apartment regarding their
common areas and facilities shall be deemed to be
transferred from the promoter to the Association which shall
thereupon maintain them.
This subject matter comes under the purview/prerogative of
the Welfare Association as per “UP Apartment Act 2010”. The
Urbtech/ Hilead Infothech should refund excess money
charged and stop demanding these charges further.
9. Incomplete Formalities for Possession
a) Form of Declaration (Sub Section-1 of Section 12 of
“UP Apartment Act”)
They have not provided the aforesaid documents either
to the Competent Authority i.e. in this case Noida
Authority nor to us. The “Form of Declaration” justifies
the loading imposed by you on buyers. The Act makes it
mandatory to provide these documents.
b) Registration of Deed of Units
They are offering us possession without appropriate
approvals from NOIDA and other authorities as per IT
Policy and without registration of sale/transfer.
Moreover you are offering possession only for fitout
purposes and not complete possession to run and
operate our businesses, which is not as per law.
10. • Maintenance Agreement
They have sent a 33 pages Maintenance Agreement to some
of us, which is vague, one sided, and totally in
contradiction/violation of Rights of Apartment/Unit holders
as mentioned in “UP Apartment Act 2010”. They should
provide us “Maintenance Agreement” document as per “UP
Apartment Act 2010” which safeguards the Rights of
Apartment/Unit holders as mentioned in “UP Apartment Act
2010”.
M/s. Hi Lead Infotech / Urbtech is not serious enough
to reply the letters /communication of your buyers,
even not giving time for the meeting to discuss the
buyers problem, While they have already sold major
components of the project and made huge profits but
the buyers are suffering, who had invested their hard
earned money, which is at risk now, they feel harassed
and cheated by the CMD of the Company.
