The Argentinean Collective Mark Law (Act 26355 of 2008) is a
very particular kind of trademark legislation. Argentinean Collective
TMs’ main features are:
    1. They have no background in national law.

    2. Their owner can only be an entity or an association working in
        the field of the social economy.
    3. Their “users” are the members of that association who meet
        the conditions laid down by law and regulation.
    4. They may be collective marks of “products" or “services”.

    5. An association can own more than one "collective mark”,
        without limitation.
    6. No co-ownership is accepted. The Collective Mark owner can
        be only one single association.
    7. The formalities relating to collective marks are expressly
        exempted from all kinds of tariffs.
    8. Acting Government agencies must act "expeditiously" in order
        to facilitate the collective mark proceedings.
    9. The Argentinean TM Authority (National Institute of Industrial
        Property) must decide on the "oppositions" that arise during
        the application. Its decision is appealable to the Federal
        Courts of Appeal in Civil and Commercial located in the City
        of Buenos Aires.
    10. An "opposition" against a collective mark application must pay
        twice the amount set by the TM Authority to the oppositions to
        traditional TMs.
    11. If in doubt about the applicable law, the TM Authority must
        choose the most favorable law for the association.
    12. Its purpose is twofold:
