Section I. Introduction
Prior to the 2016 Legislative Regular Session, AARP Florida advised legislators that it would publish
this final report on voting records for bills identified by AARP Florida as having special significance for
our members and Florida’s older residents. When a bill was selected for vote recording and was placed
on an agenda to be heard, AARP Florida notified legislators by email (see p. 74 for an example). The
email stated that AARP Florida would track the bill and report the votes on that bill, or any successor bill
through the entire legislative process. AARP Florida also provided updates on the status of the bill to its
volunteers and stakeholders through the AARP Florida blog, AARP Florida Facebook and AARP Florida
Twitter accounts.
Section I provides a complete list of all Florida legislators and their parties, districts, and county
legislative delegations. Section II provides a summary of all the bills AARP Florida selected for the final
voting record report separated by subject matter (budget, health and supportive services, consumer
protections, livable communities and bills supported but not noticed). The summaries identify the pages
where readers may review the voting records for each bill. Section III provides appendices that include
sample communications to legislators and bills selected for vote recording by date of notice.

General Appropriations Act for Fiscal Year 2016-2017
HB 5001 General Appropriations Act 2016 and
HB 5003 Implementing 2016-2017 General
Appropriations Act by House Appropriations
Committee, PASSED. The companion bills were SB 2500
General Appropriations Act and SB 2502 Implementing
the 2016-2017 General Appropriations Act by Senate
Appropriations Committee. The bills are now Chapter
No. 2016-66 & Chapter No. 2016-62 Laws of Florida,
effective July 1, 2016. The Florida Legislature passed a
$82.3 billion budget for Florida’s Fiscal Year 2016-2017.
Some impacts from the appropriations act include:
Statewide Medicaid Managed Care Long Term Care
(SMMC LTC): SMMC LTC will receive an increase of
$8,138,151 to serve approximately 509 wait-listed seniors.
The program is designed to provide home-and-community-
based services to indigent Medicaid recipients requiring
nursing facility level of care and who are 65 years of age or
older or who are age 18 or older and disabled.
Program for All-Inclusive Care for the Elderly (PACE):
The budget provides an increase of $5,132,880 in funding
to serve approximately 200 additional individuals (slots)
in Palm Beach County, an increase of $1,538,856 to serve
approximately 60 additional individuals in Pinellas County
and an increase of $4,060,992 to serve approximately
134 additional individuals in Miami Dade County.
PACE provides home-and-community-based services for
individuals who would otherwise qualify for Medicaid
nursing home placement.
Alzheimer ’s Disease Initiative (ADI): Alzheimer’s
respite care services will receive an increase of $1,559,200
in General Revenue funding to serve approximately 134
wait-listed individuals. Also, $701,850 of funding for ADI
will go towards the Alzheimer’s Project, Inc., Alzheimer’s
Community Care, Jewish Family & Community Services of
Southwest Florida and Easter Seals of South Florida.
Aging and Disability Resource Centers (ADRCs): ADRCs
will receive $1,400,000, of which $100,000 is nonrecurring.
These funds will go to the 11 ADRCs, which assist older
adults with information, program eligibility, and intake and
assessment under the Statewide Medicaid Managed Care
Long Term Care program.
Community Care for the Elderly (CCE): CCE, a non-
Medicaid program, will receive an increase of $1,955,220
from the General Revenue Fund to serve approximately 324
more individuals. CCE provides home-and-community-
based services (HCBS) to seniors aged 60+ who may be at
risk of nursing home placement. CCE provides services
such as adult day care, case management, home delivered
meals, and home nursing.
Public Guardianship: The budget maintains the FY 2015-
16 funding rate of $3,000,000 from General Revenue to
operate the statewide Public Guardianship program and
$750,000 nonrecurring funds to operate otherwise unfunded
public guardianship services.
Affordable Housing: Funds are up $25 million from last
year for a total of $200.1 million. The budget includes
$64,600,000 to fund construction or rehabilitation
of rental units for older adults, the homeless, and
persons with developmental disabilities under the State
Apartment Incentive Loan (SAIL) program and it includes
$135,500,000 for the State Housing Initiatives Partnership
(SHIP) program. SHIP may use funds for emergency
repairs, new construction and rehabilitations.

Nurse Licensure Compact
HB 1061, by Representative Pigman, PASSED. The
companion bill was CS/SB 1316 by Senator Grimsley.
The legislation is now Chapter No. 2016-139, Laws
of Florida, effective on December 31, 2018, or upon
enactment of the Nurse Licensure Compact into law by
26 states, whichever occurs first. AARP supported this
legislation. The legislation authorizes Florida to enter
into the Nurse Licensure Compact (NLC), a multi-state
agreement that establishes a mutual recognition system for
the licensure of registered nurses and licensed practical

Telehealth
CS/CS/HB 7087, by Representative Sprowls and House
Select Committee on Affordable Healthcare Access,
PASSED. The companion bill was CS/CS/SB 1686 by
Senator Bean and Senator Joyner. The legislation is now
Chapter No. 2016-240, Laws of Florida, effective on July
1, 2016. AARP supported this legislation. The legislation
directs the Agency for Health Care Administration
(AHCA), the Department of Health (DOH), and the Office
of Insurance Regulation (OIR) to survey health facilities,
insurers, and HMOs, regarding the usage of telehealth.
The findings are due to the presiding officers and to the
Governor by June 30, 2018. The legislation also creates
a 15-member Telehealth Advisory Council, chaired by
the Secretary of AHCA. The Council is charged with
submitting recommendations for further legislation to the
legislative presiding officers and the Governor. That report
will be due no later than December 1, 2018. See Voting

Advanced Registered Nurse Practitioners (ARNP) and
Physician Assistant (PA) Bills:
HB 423 by Representatives Pigman and Campbell,
PASSED. The companion bill was CS/CS/CS/SB 676
by Senator Grimsley. The legislation is now Chapter
No. 2016-224, Laws of Florida, effective on April 14,
2016. AARP supported this legislation. The legislation
authorizes advanced registered nurse practitioners (ARNPs)
and licensed physician assistants (PAs) to prescribe,
dispense, order, and administer controlled substances (under
an established protocol). See Voting Record for HB 423 p.

HB 1241, by Representatives Plasencia and Campbell,
PASSED. The companion bill was CS/SB 152 by Senator
Grimsley. The legislation is now Chapter No. 2016-
145, Laws of Florida, effective on July 1, 2016. AARP
supported this legislation. The legislation authorizes an
ARNP to order any medication administered to a patient
in a hospital, ambulatory surgical center, mobile surgical
facility, or nursing home, as long as the prescription order
falls within the framework of an established protocol with
a physician The bill also authorizes a physician to delegate
authority to a PA to order medicinal drugs for a patient in a

CS/HB 375, by Representative Steube, PASSED. The
companion bill was CS/CS/SB 748 by Senator Flores.
The legislation is now Chapter No. 2016-125, Laws of
Florida, effective on July 1, 2016. AARP supported this
legislation. The legislation clarifies that a PA may perform
any duty or service delegated by a supervising physician
unless the PA is expressly prohibited by statute or rule
from providing such duty service. The bill also authorizes
PA’s prescriptions to be in a written or electronic form, as
long as they comply with prescription labeling information

CS/SB 946, by Senator Grimsley, FAILED. AARP
supported this legislation. The legislation would have
authorized ARNPs and PAs to order controlled substances
for administration in specified facilities, but only to the
extent authorized under a supervising physician’s protocol.
The language was subsumed under HB 423. See Voting
Record for CS/SB 946 p. 31
Long-Term Care (LTC) Prioritization
CS/HB 1335, by Representative Magar, PASSED. The
companion bill was CS/SB 7056 by Senate Health Policy
Committee. The legislation is now Chapter No. 2016-147,
Laws of Florida, effective on July 1, 2016. Language was
amended onto the House and Senate bills to address
AARP’s concerns with the original bill. Thereafter,
AARP withdrew its opposition to this legislation. The
legislation sets forth specific circumstances under which
the Department of Elder Affairs (DOEA) may terminate an
individual from the home-and-community based long-term
care waitlist, and provides that DOEA must do some case
management and must document its efforts before removing

Health Insurance Coverage for Emergency Services
CS/CS/CS/HB 221, by Representative Trujillo, PASSED.
The companion bill was CS/CS/CS/SB 1442 by Senator
Garcia. The legislation is now Chapter No. 2016-
222, Laws of Florida, effective on July 1, 2016. AARP
supported the bill. The legislation prohibits the practice of
balance billing, which can occur when individuals receive
emergency treatments from health care providers who or
which are not part of their insurance plan’s networks. The
legislation also requires Preferred Provider Organizations
(PPOs) to publish a list of their network providers on their
website and requires PPOs to notify subscribers regarding
the potential for balance billing when using out-of-network

Health Plan Regulatory Administration
CS/CS/SB 1170 by Senator Detert, PASSED. The
companion bill was CS/CS/HB 951, by Representative
Cummings. The legislation is now Chapter No. 2016-
194, Laws of Florida, effective on July 1, 2016. AARP
supported the bill. The legislation updates provisions in
the Insurance Code and other Florida Statutes that are in
conflict with the federal Patient Protection and Affordable

Transparency in Health Care
CS/CS/HB 1175 by Representative Sprowls, PASSED.
The companion bill was CS/SB 1496 by Senator Bradley.
The legislation is now Chapter No. 2016-234, Laws of
Florida, effective on July 1, 2016. AARP monitored this
legislation. The legislation increases consumer health
care transparency by requiring the Agency for Health Care
Administration (AHCA) to contract for an online platform
that allows consumers to search and compare provider

Sunset Review of Medicaid Dental Services
HB 819, by Representative Diaz (J), PASSED. The
companion bill was SB 994 by Senator Negron. The
legislation is now Chapter No. 2016-109, Laws of
Florida, effective on July 1, 2016. AARP supported this
legislation. By December 2016, this legislation requires
the Agency for Health Care Administration (AHCA) to
provide the Governor, President of the Senate, and Speaker
of the House of Representatives a comprehensive analysis
of the effectiveness of the Medicaid managed care plans
for increasing access to dental care, for improving dental
health, for achieving satisfactory outcomes for recipients
and providers, and for delivering value transparency to
the state’s taxpayers. If the 2017 Legislature fails to adopt
alternative Medicaid dental coverage legislation, this
legislation eliminates dental care as a mandatory coverage
in Medicaid in 2019, but provides that the AHCA shall
establish a Medicaid dental coverage program, separate
from the acute health care system. Unlike the current
program, that new separate program would have to cover
children and adults (currently only children have mandated
coverage; services to adults, if any, are incidental as
managed care organizations choose). See Voting Record for

Dental Care
CS/CS/HB 139, by Representative Cummings, PASSED.
The companion bill was CS/SB 234 by Senator Gaetz.
The Governor VETOED this legislation. AARP
supported this legislation. The legislation creates joint
state and local dental care access accounts to incentivize
Florida-licensed dentists to serve underinsured or uninsured
patients in areas of the state where there are shortages of

CS/SB 1084 by Senator Gaetz, FAILED. AARP supported
this legislation. The legislation would have created the
“Right Medicine, Right Time Act”, which would have
required Medicaid managed care plans, health maintenance
organizations (HMOs) and other insurers to establish a
process to request an override of any medication step-
therapy or fail-first protocol established by them. See

Ambulatory Surgical Centers
CS/CS/SB 212, by Senator Gaetz, FAILED. The
companion bill was HB 85 by Representative
Fitzenhagen. AARP supported the initial bill, but
that became a legislative “train” incorporating other
provisions from CS/SB 234 and CS/SB 1084. See above
entries regarding language which was incorporated into this
bill and would have established the “Right Medicine, Right
Time Act” and dental care access accounts. The original
legislation would have allowed patients in an ambulatory
surgical center (ACS) to stay in the center for up to 24 hours
instead of up to midnight of the day of admission (current

CS/CS/CS/SB 232, by Senator Detert, PASSED. The
companion bill was CS/CS/CS/HB 403 by Representative
Ahern. The legislation is now Chapter No. 2016-40,
Laws of Florida, and is current law. AARP supported
this legislation. The legislation establishes regulation
and supervision of professional guardians by the
Department of Elder Affairs. The office is given the
additional responsibility of administering the regulation
of professional guardians, receiving and investigating
complaints, and taking administrative disciplinary action

Digital Assets
CS/CS/SB 494, by Senator Hukill, PASSED. The
companion bill was CS/HB 747 by Representative Fant.
The legislation is now Chapter No. 2016-46, Laws of
Florida, effective on July 1, 2016. AARP supported this
legislation. The legislation creates the “Florida Fiduciary
Access to Digital Assets Act” authorizing fiduciaries to
manage the digital assets and electronic communications
of decedents, incapacitated persons, settlors, principals,
and wards. This would be done in a manner similar to how
fiduciaries manage tangible assets and accounts. See Voting

Missing Persons with Special Needs
CS/SB 230, by Senator Dean, PASSED. The companion
bill was CS/CS/CS/CS/HB 11 by Representative Porter.
The legislation is now Chapter No. 2016-186, Laws of
Florida, effective on July 1, 2016. AARP supported this
legislation. This bill institutes a pilot program in seven
counties to provide personal location devices to persons
with special needs in order to aid in search and rescue
efforts for them. The pilot program will be voluntary and
at no cost to the participants. The issuing centers will work
with families, caregivers, and professionals to optimize the
potential to locate missing persons with autism and other

Medical Records (Ratification of administrative rules of
the Board of Medicine)
PCB RORS2, by Rulemaking Oversight & Repeal
Subcommittee, FAILED. AARP opposed this legislation.
The legislation would have ratified a Board of Medicine
proposed rule which would have authorized physicians to
charge consumers up to 300% more than presently allowed
for copies of physicians’ medical records. AARP FL was
instrumental in garnering legislative refusal to ratify this
rule. Although the Board of Medicine rejected AARP FL’s
persistent efforts in opposition to the proposed rule during
the rule-making process, AARP FL’s last-stand testimony in
the House proved pivotal to legislative rejection of the rule.
Medical Examiners
CS/SB 620 by Senator Grimsley, FAILED. The
companion bill was CS/HB 315, by Representative
Roberson. The language was adopted as an amendment
to an amendment to CS/CS/HB 941. AARP supported
this legislation. The legislation would have prohibited a
medical examiner or a county from charging a member
of the public a fee for a cremation approval certificate. It
would have provided an exception that would allow counties
to enact an ordinance or resolution that authorized medical
examiners to charge an approval fee of up to $50 under
certain circumstances. Currently, user fees range from no
charge in 24 counties to $63 in one county. See Voting

Consumer Protection
CS/CS/SB 148, by Senator Ring, FAILED. AARP
supported this legislation. The legislation would have
required retail sales establishments to grant a refund within
three days after the date of purchase for goods costing
more than $1,000 if returned by a consumer who has been
adjudicated incapacitated, subject to a guardianship or has
been diagnosed with a medical condition that causes the
consumer to lack sufficient understanding or capacity to
make reasonable decisions concerning his or her person or

Consumer Finance
CS/HB 1425, by Representative Fant, FAILED. The
companion bill, SB 1696, by Senator Flores, never had
a committee hearing. AARP monitored this legislation.
The legislation would have established the Access to
Responsible Small-Dollar Loans Pilot Program. The
program would have allowed consumers to enter into a
“program loan” with a principal amount of at least $300
up to a maximum of $3,000, at a fixed interest rate not to
exceed 36 percent per annum calculated by simple interest,
for a term of not less than 120 days. Under current law,
licensed consumer finance lenders may make loans in this
amount at a maximum rate of 30 percent, with no minimum

Professional Guardians

Bean. The legislation is now Chapter No. 2016-221, Laws
of Florida, effective on July 1, 2016. AARP supported
this legislation. The legislation directs the Department of
Agriculture and Consumer Services (DACS) to create a
Healthy Food Financing Initiative Pilot Program. Healthy
Food Financing Initiatives are programs designed to make
funding available (in the form of loans, grants, promotions,
and other programs) to establish access to healthy food
options in locations where those option are otherwise
