A.M.V.E.A.
These Guidelines on Market Conduct are issued for observance by our Members of the
Association of Motor Vehicle Engineers & Assessors (A.M.V.E.A.)
These guidelines set the minimum standards for proper conduct of the Members of
A.M.V.E.A. in performing their duties. The aim of these guidelines is to enhance best
practices in the conduct of the Motor Vehicle Accident Repair Industry including Insurance
Engineers & Assessors, Independent Engineers & Assessors and Vehicle Damage Assessors
and to improve the image of the accident repair industry from all industry areas related to the
Motor Vehicle Repair.
A.M.V.E.A. recognise that trust is vested in the Motor Vehicle Engineer Assessor and by
observing these guidelines in the conduct of their business, integrity; moral standards and
professionalism will be enhanced.
To this end, A.M.V.E.A. hereby issues these Guidelines on Market Conduct and the Code of
Practice for the Motor Vehicle Engineer Assessor to be effected from 1st October 2012.

1.0 Authorization
A.M.V.E.A. issues these Guidelines for observance by Motor Vehicle Engineer Assessor
in order to ensure compliance with best practices in the conduct of business by Motor
Vehicle Engineer Assessors.
2.0 General Introduction
A.M.V.E.A. has a mission to develop, formulate and enforce supervisory standards for
the conduct of the Motor Vehicle Engineer Assessor who are recognized by many
organizations.
A.M.V.E.A. recognizes the role Motor Vehicle Engineer Assessors play in the claims
management process by investigating and assessing losses in the insurance industry as
well as detecting fraud. Reports by Motor Vehicle Engineer Assessor determine the
admissibility of a claim and the amount payable.
A.M.V.E.A. recognizes that trust is vested on the Motor Vehicle Engineer Assessor and
by observing these guidelines in the conduct of their business, integrity; moral
standards and professionalism will be enhanced. Motor Vehicle Engineer Assessors shall
maintain confidentiality, preserve independence and neutrality without jeopardizing the
interests of the insurer and claimant. This would promote public confidence in the
profession.
A.M.V.E.A. further recognizes the fact that Motor Vehicle Engineer Assessor has a role
to play in improving the image of the insurance industry and their conduct is pivotal to
its development. Insurers, claimants and other interested parties have a right to deal
with honest, trustworthy and knowledgeable Motor Vehicle Engineer Assessors.
Finally, A.M.V.E.A. recognizes the consumers’ fundamental right to information as
enshrined in The Freedom of Information Act.
3.0 Application
3.1. These guidelines shall apply to all Motor Vehicle Engineer Assessors who are
members of A.M.V.E.A.
3.2. All Motor Vehicle Engineer Assessors who are members of A.M.V.E.A. shall be
required to adhere to these guidelines in their conduct of insurance and their business.

3.3. These Guidelines should be read in conjunction with the provisions of any Acts of
Law as well as directions, notices, circulars and other guidelines that A.M.V.E.A. may
issue from time to time.
4.0 Definitions
In these guidelines references to the following terms shall have the meaning assigned
in this article:
4.1. A.M.V.E.A. means Association of Motor Vehicle Engineers & Assessors.
4.2. Claimant means a person who has a right to a settlement arising from a contract
of insurance.
4.3. Motor Vehicle Engineer Assessor means persons who carry on the business of
assessing, estimating, valuing, advising and negotiating losses on behalf of the
principal, insured or any other interested parties and persons who carry on the
business of investigating losses and tracing, on behalf of the insurer, insured or any
other interested parties.
4.4. Insured means a policyholder.
4.5. Principal refers to the insurer, insured or any other interested parties on whose
instructions a Motor Vehicle Engineer Assessor provides a service.
4.7. Professional engagement means insurance business that the independent
vehicle damage assessor is authorized to transact by the Authority.
5.0 Objectives
These Guidelines set out the market conduct and service standards in order to:
a. uphold integrity and preserve the professionalism of the Motor Vehicle Engineer
Assessors,
b. provide for the effective control of the professional conduct of Motor Vehicle
Engineer Assessors,
c. promote the skills, efficiency and responsibilities of the Motor Vehicle Engineer
Assessors.

6.0 Principles for the conduct of Business,
6.1 Ethical Conduct
6.1.1 The relationship between the Motor Vehicle Engineer Assessors and its
principal(s) is one of trust. Therefore Motor Vehicle Engineer Assessors shall observe
the highest degree of good faith in all transactions.
6.1.2 Every member shall;
a. act ethically and with integrity.
b. conduct business with courtesy and consideration to all people with whom contact is
made in the course of duty.
c. ensure charges to the client shall be the only remuneration in connection with such
work.
d. Not accept instructions on the basis that no charge will be made unless a successful
result is achieved.
6.2 Professional Conduct A to Z Guide
Every Member shall;
a. accept the Code of Conduct as a condition of membership of A.M.V.E.A.
b. uphold the standing of the profession and A.M.V.E.A. and conduct themselves in
such a manner as not to bring the profession or the A.M.V.E.A. into disrepute.
c. be strictly professional in their approach to the public, business colleagues and all
those whom they meet in their day to day business activities.
d. be polite and courteous at all times and perform their duties and observe their
responsibilities to their employers, staff, customers and the public with integrity,
courtesy and consideration.
e. take all reasonable steps to ensure that work undertaken by staff under their
control is performed with integrity, courtesy and consideration.
f. not incur personal gain through abuse of their professional position.

g. work within the framework of the law at all times, particularly relating to the
operation of the organisation with which they are connected.
h. not directly, indirectly or unfairly injure the reputation of another member.
i. only accept or perform work in insurance business for which it is authorized to
transact.
j. act within the authority and instructions of the principal,
k. declare at inception or in the course of engagement whether there is any conflict of
interest, and where one arises, to disclose and decline to act,
l. only accept or perform work which it is competent to undertake,
m. be objective and impartial in the conduct of duty,
n. maintain confidentiality, preserve independence and neutrality without jeopardizing
the interests of the insurer , the insured , claimant or any other interested party,
o. carry out the investigation or assessment work promptly and fairly and submit a
report to the principal as expeditiously as possible,
p. carry out investigation or assessment work with due diligence, care and skill and
with proper regard to the requisite technical and professional standards,
q. take reasonable steps to keep the principal informed of the status of the assignment
and respond promptly to the principal’s instructions,
r. conduct the assignment in a fair, transparent and honest manner,
s. recommend and encourage the settlement of legitimate claims,
t. at all times maintain proper record of work done and comply with all relevant laws,
u. use any confidential information acquired or received in the course of professional
work for the intended purpose only and fully comply with the Data Protection Act.

v. maintain professional competence and skills in respect of all developments and
legislation applicable to this profession.
w. encourage staff under their control to raise their educational standards and skill
through training and development and keep up to date the A.M.V.E.A. passport.
x. exercise impartial independent judgement as though operating as an independent
expert responsible to the Court.
y. all reports shall contain but not limited to data as recommended by the association.
z. hold in their possession photographic identification and evidence of their
membership at all times.
7.0 Disclosure of information
Every Motor Vehicle Engineer Assessors shall;
a. accurately disclose its role in any professional engagement,
b. disclose to the insured, claimant or any other third party the principal on whose
behalf they are acting,
c. only disclose information, pertaining to an insurer, insured or claimant acquired in
the course of engagement, to any third party, with the consent of the concerned party,
d. Disclose to the principal all information material to the loss in accordance with the
policy terms.
8.0 Presentation of Reports
Every Motor Vehicle Engineer Assessors shall;
a. Ensure that the reports issued comply with all statutory requirements and meet the
requisite professional standards.
b. Ensure that reports are submitted to the principal as expeditiously as possible.
c. Disclose to the principal relevant information obtained in the course of its
professional engagement.

9.0 Training
Motor Vehicle Engineer Assessors shall;
a. be required to possess technical and professional knowledge and skill in their area
of practice and as may be prescribed by the Authority from time to time.
b. act with competence and strive to maintain knowledge and expertise necessary for
the proper conduct of their business.
c. keep abreast of developments in the insurance and accident repair industry and
their relevant area of expertise.
d. ensure that its staff are suitably qualified and competent to act in the capacity so
employed.
e. endeavour to be members of professional associations relevant to the insurance and
accident repair industry.
10.0 Enforcement of the Guidelines & Code of Practice
A.M.V.E.A. shall,
a. enforce these guidelines against the Motor Vehicle Engineer Assessors.
b. call on the Executive Committee of A.M.V.E.A. to vote for a decision, only a
unanimous decision shall determine whether or not a breach of these rules has been
committed.
c. withdraw or suspend from the membership register any member who continually
acts outside of these guide lines and code of practice, or who is convicted of a
criminal offence, which calls into disrepute his integrity. A notice period of 48 hours
for suspension and 30 days for withdraw in writing will be given after a decision of
the Executive Committee of the intention to withdraw. Representations and appeals
against such withdrawal may be made in writing to the Executive Committee.
d. by a resolution of the Executive Committee expel a member, if any member shall
refuse or wilfully neglect to comply with any of the articles or shall have been guilty
of such conduct as in the opinion of the Executive Committee either shall have
rendered him unfit to remain a member of A.M.V.E.A. or shall be injurious to the
association or such member. Provided that such member shall have been given 30
days’ notice of the intended resolution for his expulsion and shall have been
afforded an opportunity of giving orally to the Executive Committee of A.M.V.E.A.
or in writing to the Executive Committee any explanation or defence the member
may think fit. The name and recorded address of a member expelled under this
article shall be published in such manner as the Executive Committee may decide.
