WhatisaSelf-Managed
SuperannuationFund(SMSF)?
By definition, a SMSF is a superannuation fund that
has less than five members and each member of the
fund is required to act as a trustee or be a Director of a
Corporate trustee entity.
Regulated by the Australian Tax Office (ATO) a
SMSF may be considered a useful alternative to
superannuation funds regulated by the Australian
Prudential Regulatory Authority (APRA).
The main advantage of a SMSF is the ability of the fund
members to exercise greater control over investment
decisions of the fund.
Trusteedutiesandresponsibilities
SMSF trustees ultimately have the responsibility when
it comes to the operation, management and compliance
of the fund. Their primary obligation is to ensure the
fund is maintained only for the purpose of providing
benefits to its members upon their retirement (or
attainment of a certain age), or their beneficiaries if a
member dies. This is referred to as the Sole Purpose
test.
Knowyourresponsibilities
Trustees are required by law to:
• Act honestly in all matters concerning the fund
• Exercise skill, care and diligence in managing the fund
• Act in the best interests of the members of the fund
• Ensure that members only access their
superannuation benefits if they have met a legitimate
condition of release
• Refrain from entering into transactions that circumvent
restrictions on the payment of benefits
• Ensure that members’ personal monies are kept
separate from the money and other assets of the fund
• Take appropriate action to protect the fund assets
• Comply with all regulations under the Superannuation
Industry Supervision (SIS) Act
• Prepare, implement and regularly review a fund
investment strategy
ATOTrusteeDeclaration
Each new SMSF trustee is required to complete a
Trustee Declaration form, issued by the ATO, within
21 days of becoming a SMSF trustee. Furthermore,
this document must be retained for 10 years or whilst
remaining a trustee, whichever is longer. The Trustee
Declaration must be made available for inspection by
the ATO at any time. Failure to produce the document
may result in penalties being imposed by the ATO.
TheAdministrator
Anne Street Partners Super Solutions is the tax agent
and administrator for your SMSF. Our role is to assist
with your annual compliance requirements, which
includes preparing the annual financial statements
and tax return, lodging the annual tax return with the
ATO and arranging the annual audit of the fund by an
approved auditor.
A dedicated team member will contact you at the start of
each financial year with a detailed query list required to
complete the annual financial statements and tax return.
TheAuditor
It is a requirement that each SMSF is audited by an
approved auditor on an annual basis. Anne Street
Partners Super Solutions utilises a panel of approved
auditors for its clients’ annual audit requirements. The
auditor will notify the trustee(s) of any concerns raised
during the annual audit. Depending on the severity, the
auditor may be required to inform the ATO of the issue
or concern.
Criticaldates
A SMSF reporting period is a standard financial year
(1 July to 30 June). When utilising the services of a tax
agent, the following ATO lodgement deadlines apply to
self-managed super funds:
• Newly established funds – 28 February in the year
following the financial year of establishment, ie. funds
established in the 2015 financial year will have a
lodgement deadline of 28 February 2016.
• Continuing funds – 15 May in the year following
the financial year, ie. funds continuing in the 2015
financial year will have a lodgement deadline of 15
May 2016.

Failure to lodge by the deadlines above may result
in the ATO imposing a revised lodgement deadline
of 31 October in the following year, ie. funds late for
lodgement in the 2014 financial year may receive a
revised lodgement deadline of 31 October 2015 for the
2015 financial year. Furthermore, it is likely that financial
and administrative penalties will be applied by the ATO
to the trustee(s).
Keepingrecords
It is the trustee’s responsibility to maintain accurate and
readily available records, which include:
• All tax documents
• Other records of the SMSF
The table below specifies how long the ATO requires
various documents to be kept for.
Should any of these documents be unavailable for
review within the relevant time period, then a penalty
may be imposed by the ATO. Depending on a number
of factors, penalties can range from $850 to $10,000
per offence. For record-keeping offences, penalties are
usually around $1,700. Fines cannot be paid from your
fund and must be paid from personal monies.
It’s important to update Anne Street Partners Super
Solutions when your contact details change. If your fund
utilises a Corporate trustee structure, we can provide
assistance with notifying ASIC of the changes.
Personalinsurance
It is a requirement that the trustee considers the
adoption of personal risk protection (personal
insurance) for the members of the fund as part of the
overall strategy of the fund.
Effective 1 July 2014, a SMSF is only permitted to
provide members with insured benefits that can
be accessed on death, terminal medical condition,
permanent incapacity and temporary incapacity as
defined in the Superannuation Industry Supervision
(SIS) Act. Transitional rules will apply to existing
insurance policies held by the fund at 1 July 2014.
Deathbenefitnominations
Superannuation death benefit nominations allow you to
nominate who will receive your superannuation benefits
in the event of your death. Death benefit nominations
can be binding or non-binding on the trustee.
Superannuation death benefits can only be paid to the
following:
• Spouse
• Children
• Person with ‘interdependency relationship’
• Financial dependant
• Personal legal representative
Superannuation death benefits do not automatically
form part of your estate upon death. Accordingly, fund
members should provide the super fund trustee with
sufficient direction to ensure their superannuation death
benefits are paid as per their wishes.

SuperStream
SuperStream is a Government reform aimed at
improving the efficiency of the superannuation system.
Under SuperStream, employers must make super
contributions on behalf of their employees by submitting
data and payments electronically in accordance
with the SuperStream standard. All superannuation
funds, including SMSFs, must receive contributions
electronically in accordance with this standard.
Upon establishment of your SMSF you will receive
SuperStream details to provide to your employer, which
include the Electronic Service Address (ESA), the fund
Australian Business Number (ABN) and the fund bank
account details.
