1 . Where can the lawsuit can be heard? - The lawsuit should be brought to the court  of territory at which defendant resides.  - The people concerned can negotiate themselves to transfer the lawsuit to the court of territory at which plaintiff resides. The negotiate documents are required.  (Civil Procedural Law 2004, Title 1, Chapter  III, section 1, § 35).  2. Vietnamese court decisions: Defendant has the responsibility to  pay plaintiff damages .  (Civil Law 2005, Part 3, Chapter XXI,  section 1, § 605, 607, 609)  Some noticeable points: - The maximum damages if the  two parties can not negotiate is 30 time the minimum wage. - Time to sue is maximum 2 years from the day of damage. 3. Insurance – a considerable solution for defendant in accident lawsuits  (Civil Law 2005, Part 3, Chapter XXVIII, section 11, § 580)
