1. Now, this Deed of Agreement executed on this day Dec’ 2008 between, Beam
Consultancy Services, 5/94, Mela anuppanadi, Madurai, Tamilnadu herein after called
the “institution” which expression shall wherever the context so permits include their
Executors, Legal Representative and assigns of the one Part and the Commissioner,
Backward Classes Welfare Department, Chepauk, Chennai-5 hereinafter called the
“Commissioner” which term shall wherever the context so permits include their
Executors, Legal Representative and assigns of the second part.
Whereas the Institution hereby agrees to train totally 20 Candidates at the rate of
Rs.4000 (Rupees four thousand only) per candidate (including course materials, raw
materials etc.) of Backward Classes, Most Backward Classes and Denotified
Communities (excluding minorities) in Certificate course in web Authoring.
The Institution hereby agrees for the terms and conditions as stipulated by the
Commissioner of Backward Classes Welfare, Chepauk, Chennai-5 detailed below:Terms & Conditions of Department of Backward Classes Welfare, Chepquk,
Chennai-5.
Terms and Conditions for training to be conducted by Beam Consultancy Services,
5/94, Mela anuppanadi, Madurai, Tamilnadu in the field of Certificate course in web
Authoring to 20 candidates belonging to Backward Classes, Most Backward Classes
and Denotified Communities (excluding minorities) during 2008-09 are as follows:
1. The Institution shall conduct “Certificate course in web Authoring” Sanctioned
as per G.O.(D) No.88 Backward Classes, Most Backward Classes Welfare
Department, dated 11.8.2008 and as per this office proceedings
Pro.No:C2/7021/2008. and date:12.12.2008 to 20 Backward Classes, Most
Backward Classes and Denotified Communities candidates (excluding
minorities for the year 2008-09.
2. The Course details have been narrated in the G.O.(D) No.88, BC, MBC, and
Minorities Welfare Department, dated 11.8.2008 and the Tender Documents
already Submitted by the institution.
3. The details of eligible applications from the prospective Backward Classes,
Most Backward Classes and Denotified Communities candidates (excluding
minorities) should be computerized by the Institution.
4. At the time of the said Interview or Aptitude test, the Certificates of
candidates appearing for interview will be scrutinized by the Officials of this
Commissionerate.
5. The selection of Candidates to undergo the training shall be done by the
Selection Committee, constituted by the Commissioner of Backward Classes
Welfare.
6. No candidates who has been admitted to the courses stipulated in G.O.(D)
N0.88, Backward Classes, Most Backward Classes Welfare Department,
Dated 11.8.2008 & this Office proceedings No: Pro.No:C2/7021/2008. and
date:12.12.2008 shall be allowed to discontinue in the middle of the training
period without specific orders of the Commissioner of Backward Classes
Welfare, Chennai-5 and if the candidates are absent for more than three days
the fact may be intimated to this Commissionerate within a week’s time.
2. 7. The course fee for the above said course has been fixed at Rs.4000 in the
proceedings of the Commissioner of Backward Classes Welfare No:
Pro.No:C2/7021/2008. and date: 12.12.2008. The course fee (Rs.4000) will
be paid by this Department based on the number of admissions of the
candidates made by the Institution. Other than this, the Institution should not
collect any amount from the candidates during the period of training. The
institution should not increase the course fee agreed to by the institution and
fixed in the proceedings of Commissioner of Backward Classes, Chepauk,
Chennai-5 in Pro.No:C2/7021/2008. and date:12.12.2008 during the period
of training under any circumstances.
8. An undertaking letter from the candidates should be obtained in duplicate and
one copy should be retained in the Institution and another copy should be
sent to this Commissionerate after admission of the candidates.
9. A copy of the Course Syllabus which is already prescribed by this
Department should be given to the trainees at the time of commencement of
the course.
10. If the candidates Drop-out in the middle of the training period the
following procedures will be adopted for refund of course fees
6 Months Course
a) With in a month from the date of commencement of training,
the course fee will not be paid pertaining to the drop-out
candidates.
b) Beyond One month, but before the end of the third month, this
Department shall pay 30% of the course fee to the Institution.
c) Beyond third month, but before the end of the fifth month, this
Department shall pay 60% of the course fee to the Institution.
d) Beyond fifth month, but before the end of the course, this
Department shall pay 80% of the course fee to the Institution.
11. The Institution should maintain separate Admission Register, Attendance
Register, Leave letters obtained from students and proper accounts etc., and
the same should be made available for inspection by the officials of this
Commissionerate.
12. The Institution shall refund the unspent amount soon after any candidate
drops out or at the end of the training period whichever is earlier.
13. The Institution shall send the monthly attendance/ Performance report of the
candidates to this Department before 5th of ever y month.
14. The printing of the training completion certificates to be issued to the
candidates shall be the responsibility of the Institution. The printing of the
certificates should be done as decided and approved by this Department.
15. The Institution shall arrange for placement to the beneficiaries to the
maximum possible extent and should assist the Department of Backward
Classes Welfare to valuate the benefits of the scheme by distributing
Printed Inland letters affixed with stamps (or in any form as desired by
this Department in future) to the beneficiaries at the end of training period,
at the expense of the institution.
3. 16. The Institution shall provide all information/reports related to the above
scheme as and when sought for by the Department of Backward Classes
Welfare, Chennai-5.
17. The Commissioner of Backward Classes Welfare or his nominee has the
power to inspect the Institution whenever necessary for verifying the
implementation of the training programme. For any malpractice or breach of
this agreement, the Commissioner of Backward Classes Welfare has the right
to take necessary action for cancellation of the institute’s
recognition/Blacklisting the institution’s name to impart training in future.
18. The Institute shall do the following:
i)After admission of candidates, the Institution shall send the following
reports along with CD;

ii) During the Training period:
A monthly report on the attendance and performance of the candidates should
Be sent to this Department before 5th of every month during the training period

(for putting Signature of the Commissioner/Director of Backward Classes
Welfare)
e) Placement Details Report
f) Photos of the valedictory function-5 No’s.
g) Profile with CD
19. The Institution should obtain the original Educational Certificates from the
students at the time of admission and these should be returned to the
students immediately after the course completion.
4. 20. In respect of the discontinued candidates, their Original Educational
Certificates should be returned, only after refund of the course fee paid
by the Government for them. Prior permission must be obtained from this
Department before returning the certificates to the students.
21. As per Tamil Nadu Transparency Tender Acts 1998 and Rules 2000, the
Institute shall deposit an amount equivalent to 5% of the total value of
contract on Security Deposit. The 5% of the Security Deposit may be drawn
in Demand Draft in favour of “ Commissioner of Backward Classes Welfare,,
Chepuak, Chennai-5” obtained from any nationalized bank payable at
Chennai.
22. The Security deposit will be refunded to the Institution only after the receipt of
details of placement arranged/got by the candidates and to the satisfaction of
the Commissioner.
