Abstract
The dissertation explores one of today's most pressing issues which is the internet. Nowadays the
internet impacts all of the life daily economic, social, cultural, political, legal and human aspects.
As law represents a cultural component which reflects the current situation of society at large, the
internet had to be regulated by a legal framework to guarantee and maintain its sustainability.
Given the disparity between the current real legal framework which is based on the physical
natural borders and the very global nature of the internet which resists regulation, the dissertation
role is to promote the urgency of creating new legal mentality to discover the legal rules and
principles necessary to regulate the cyberspace.
The research depends on the international law main role to lead this regulation, the state role and
the mechanism for enforcing its sovereignty over the cyberspace. After looking at the similar
international regulations of the cyberspace as one that can't be governed by any state, the research
outlines the major international agreements that regulate cyberspace from a criminal and
commercial point of view through depending on principles of the international law such as the
Common Heritage of Mankind Principle and considering the internet as part and parcel of this
heritage, making the agreements and conventions necessary to control and regulate the internet
and creating an independent international regulation authority with binding executive
mechanisms under the United Nations umbrella. The research also features all the needed
components of this authority and the major international bodies which offered to carry out this
task. The research argues that it is crucial to introduce a new law to regulate the internet which
suits its very border-crossing nature. This wouldn't be possible unless the international law
principles are adopted. This new legal branch has its own legal rules. The international academic
studies refer to it as the "International Law of the Internet".
