I have had the privilege of working with Mr Frederick Pohl (trading as Enviro-
Assess) during the Bathlabine matter (more details below). I was appointed as
consultant by the Centre for Environmental Rights ("CER") to assist with the
investigation and the prosecution of the above matter.
The prosecution was against Blue Platinum Ventures 16 (Pty) Ltd (t/a
Bathlabine Brickyard), as well as Mr M.S. Maponya and some of the other
directors of the said company. It was on various charges relating to the
operation of clay mining sites in Tzaneen. The charges included
contraventions of the National Environmental Management Act ("NEMA"), the
Mineral and Petroleum Resources Development Act and the National Water
Act.
On 31 January 2014 at the Naphuno Regional Court, Limpopo, Blue Platinum
as well as Mr Maponya, in his personal capacity, were convicted, after a plea
of guilty, on one of the counts under NEMA. CER approached and appointed
Mr Pohl to establish an estimate of the cost to rehabilitate the five sites
affected by the mining activities (for more details on the case, see the website
cer.org.za, or the media report in the Mail & Guardian).
Mr Pohl produced a professional and thorough report on the quantum of the
rehabilitation which was accepted by the defense and court alike during the
sentencing procedure.
It was an absolute pleasure working with Mr Pohl in this matter and I will
recommend his services without any reservations. He was highly professional,
