5. Leave on Average Pay (LAP)
This rule may be called the Railway Servant
(Liberalise Leave) Rules-1949.

6. •All Railway employees permanent or temporary are eligible
for LAP.
•It is also desirable in the interest of efficiency, that the
employees take leave at suitable intervals and return to
work keen and refreshed.
•Leave should not ordinarily be denied to any employee,
especially in the last 10 years of his/her career. (78/01)
•Railway servants are eligible for 30 days of LAP every
calendar year.
•It shall be credit in advance.
•It will be credited in advance to the leave account in two
instalments @ 15 days each on1st of January and 1st July
every year.
•LAP Shall be credited at the rate of 2 ½days per month.
•The new appointees are credited LAP @2 ½ day per
calendar month.
•Gazetted officers can be sanctioned 240 days LAP if it is
sanctioned for availing outside India.

7. •Crediting of LAP in case of Retirement, death, removal,
dismissal shall be @ 2 ½ days per calendar month up to the
end of previous month preceding the Retirement/death/
removal/ death/dismissal at .the end of particular half
year.
•For example , any staff will be retire on 31st October , in
that case 10 LAP will be credit in his leave account for
current half year @ of 2 ½days per month for 4 month i.e.
July to October.
If employee is on EOL/absent/suspension/dies-Non from
duty during previous half year ,the credit of next half year
shall be reduced by 1/10th of the period of such
EOL/absent/suspension/dies-Non subject to maximum 15
days in one half of the year.
Maximum Accumulation – 300 (+15)
LAP has been carry forward for next year up to 300.
More than 300 LAP will be lapse on 30 June & 31
December.

8. • Railway employee can take LAP in one spell/at a time –
180 Days (Max.)
•Entire service –No limit
•Leave salary-Full pay
•LAP can be add with other type of leave except Casual
leave (CL).
•Where Government/Railway servants are compulsorily retired as a
measure of punishment and in whose cases even if a cut in pension
(including gratuity) has been ordered, the benefit of encashment of
earned leave at the time of such retirement shall be allowed. (62/06,

9. While sanctioning Ex-India leave to employees/officers, all Zonal
Railways/Production Units should ensure that :-
•The officers/employees shall purchase overseas medical
insurance to the tune of medical cover of at least US $ 50,000/-
prior to sanction of ex-India leave.
•All officers/employees while submitting leave application
for ex-India leave should also submit the following
declaration ;
1)I am aware that as per the provision of Indian Railway
Medical Manual relating to re-imbursement of medical
expenses incurred abroad, I am not entitled for re-
imbursement of medical expenses for treatment in emergency
or otherwise while on ex-India leave.
2)I have/will purchase adequate insurance coverage for the
medical emergency while I will be on ex-India leave (159/07)
The declaration given by the employee/officer for purchase of
overseas medical insurance is sufficient. It should not be insisted
upon. The declaration as mentioned above may be obtained from
all employees proceeding on ex-India leave irrespective of the
duration of leave applied for (227/07, 159/07)

10. Deputation Allowance (without DA) shall be taken into
account for encashment of Leave Salary.
In case of resignation, 50% of the LAP at the credit shall be
allowed for leave salary subject to maximum of 150 days.
In case of compulsory retirement, if no cut in pension is
imposed, leave salary for max 300 days is payable.
NPA payable to doctors is included for payment of leave salary.

Supervisors – Up to 15 days
Junior Scale (APO and equivalent rank) –Up to 30 days
Senior Scale (DPO and equivalent rank)-Up to 45 days
Junior Administrative Grade(Sr DPO and equivalent and above) -Full power

11. LEAVE ON AVERAGE PAY APPLICABLE TO SCHOOL STAFF
(Revised in 7th CPC)
School staff (Who avail summer vacation) are eligible for 10
days of LAP in a year which will be credited in advance in two
instalments of 5 days each on 1 st of January and July every year.
If school staff, is on EOL/absent/suspension/dies-Non from duty
during previous half year ,the credit of next half year shall be
reduced by 1/30th of the period of such EOL/absent/suspension /
dies-Non subject to maximum 15 days in one half of the year.
In respect of any year in which a Railway servant avails a portion
of the vacation, he shall be entitled to additional LAP in such
proportion of 20 days
As the number of days of vacation not taken bears to the full
vacation ,provided the total LAP credited shall not exceed 30 days in
calendar year.
If ,any year .the school staff does not avail any vacation ,LAP will
be As per Rule 523 instead of clause (a) & (b).

33. Leave encashment
Leave encashment at the time of Retirement :
• Leave at the credit of a railway servant may be encashed at the
time of retirement from railway service subject to maximum limit
of 300 days. Only Pay and Dearness Allowance are admissible.
• No other allowance is admissible for such encashment.
• For Running staff, 30% of pay element of running allowance shall
also be payable.
• For Doctors, 20% NPA is also payable.
If the LAP at the credit of a railway servant is short of 300 days,
encashment for LHAP to the extant LAP is short from 300 days
may be allowed. In case of shortfall in earned leave, no
commutation of half pay leave is permissible (281/09).
34. Leave encashment
Leave encashment at the time of Retirement :
•Both Leave on Average Pay and LHAP are to be considered for encashment at the
time of retirement, subject to the overall limit of 300 days.
• It is not applicable in the case of permanent absorption of railway employees in
PSUs/Autonomous Bodies. In other words, the existing provision of forfeiture of
LHAP standing at the credit of such railway servants on absorption in
PSUs/Autonomous bodies shall continue to be in force (175/09)
•Where Government/Railway servants are compulsorily retired as a measure of
punishment and in whose cases even if a cut in pension (including gratuity) has been
ordered, the benefit of encashment of earned leave at the time of such retirement
shall be allowed (62/06).
35. Leave encashment
In-service encashment of LAP (208/08) :
•Maximum 10 days LAP can be encashed at a time subject to maximum of 60 days in
entire service.
•The minimum gap of 2 years between two successive encashment has now been
modified.
•Now the period of two years for the purpose of successive encashment of LAP shall
be w.r.t. a two year block, the first one commencing from 1.9.2008 and ending on
31.08.2010 w.r.t. the outward journey performed.
•The next block would commence from 1.9.2010 and end on 31.08.2012 and
successive blocks would follow similar pattern (61/11).
•There shall be a balance of 30 days after deduction.
•No HRA and Transport allowance shall be payable.
•Encashment cannot be availed after availing leave.
36. The earlier facility granted to running staff and SM/ASMs i.e. sanction of
encashment of 10 days LAP without availing leave, has been withdrawn.
(115/10).
The encashment of LAP availed during service shall not be debited from
the encashment availed at the time of retirement.
If a railway servant avails PTO during leave, then also encashment of 10
days LAP is admissible (236/08).
Railway servants are permitted encashment of 10 days LAP without
linkage to the number of days and nature of leave availed at the time of
availability of pass/PTO. (136/09)
Holidays, including Restricted Holidays, do not come within the ambit of
the definition of leave for the purpose of encashment of 10 days leave
(110/11).
Leave encashment cannot be availed during CCL (33/11)
