§1 Structuur van de ambtelijke organisatie

1. Ingesteld worden de volgende ministeries:

d. het ministerie van Onderwijs, Cultuur, Jeugd en Sport;
e. het ministerie van Volksgezondheid, Sociale Ontwikkeling en Arbeid;
f. het ministerie van Toerisme, Economische Zaken, Verkeer en
Telecommunicatie;
g. het ministerie van Volkshuisvesting, Ruimtelijke Ordening, Milieu en
Infrastructuur.
2. De hoofdstructuur van de ministeries bestaat uit de volgende

b. de voorbereiding van wet- en regelgeving met betrekking tot
aangelegenheden welke het desbetreffende ministerie raken;
c. de coördinatie en uitvoering van hetgeen bij of krachtens wettelijke regeling
aan het desbetreffende ministerie in het bijzonder is opgedragen of geacht
moet worden daartoe te behoren;
d. de coördinatie en uitvoering van hetgeen krachtens medeondertekening valt
onder de verantwoordelijkheid van de minister die verantwoordelijk is voor

hiervan door de afdelingen en uitvoerende organisaties. In dit kader wordt
gekeken naar de effectiviteit en efficiëntie van beleid.
Artikel 12
Het ministerie van Algemene Zaken heeft als doelstelling het behartigen van de
eigen aangelegenheden van het Land op het gebied van binnenlandse
aangelegenheden en koninkrijksrelaties, buitenlandse betrekkingen, juridische
zaken en wetgeving, personeelsbeleid, automatisering, communicatie, publieke
en interne dienstverlening, programma- en projectmanagement, alsmede
fondsenwerving.
Artikel 13
Onverminderd artikel 9 is het ministerie van Algemene Zaken belast met de
ondersteunende taken voor alle ministeries op het gebied van:
a. personeel en organisatie;
b. informatie- en communicatietechnologie;
c. facilitaire zaken en inkoop;
d. documentatie en archief;
e. externe en interne communicatie.
Artikel 14
Het ministerie van Financiën heeft als doelstelling het behartigen van de eigen
aangelegenheden van het Land op het gebied van financiën, fiscale en monetaire
zaken, bank- en kredietwezen, alsmede het deelnemingenbeleid van Land.
Artikel 15
Het ministerie van Justitie heeft als doelstelling het scheppen van
randvoorwaarden voor de handhaving van de veiligheid, orde en rust, en de
waarborging van het recht binnen de samenleving.
Artikel 16
Het ministerie van Onderwijs, Cultuur, Jeugd en Sport heeft als doelstelling het
behartigen van de eigen aangelegenheden van het Land op het gebied van
onderwijs, cultuur, jeugd en sport.
Artikel 17

Het ministerie van Volksgezondheid, Sociale Ontwikkeling en Arbeid heeft
als doelstelling het behartigen van de eigen aangelegenheden van het Land op
het gebied van de volksgezondheid, de gezondheidszorg, de sociale ontwikkeling
en de arbeid.
Artikel 18
Het ministerie van Toerisme, Economische Zaken, Verkeer en Telecommunicatie
heeft heeft als doelstelling het behartigen van de eigen aangelegenheden van het
Land op het gebied van toerisme, economie, vervoer, telecommunicatie en de
statistiek.
Artikel 19
Het ministerie van Volkshuisvesting, Ruimtelijke Ordening, Milieu en
Infrastructuur (VROMI) heeft als doelstelling het behartigen van de eigen
aangelegenheden van het Land op het gebied van volkshuisvesting, ruimtelijke
ordening, milieu, natuur en infrastructuur.
Artikel 20
1. De taken waarmee een ministerie is of wordt belast, alsmede de inrichting en
organisatie van afdelingen en uitvoerende organisaties worden, met
inachtneming van de artikelen 3 tot en met 9, nader geregeld bij landsbesluit,
houdende algemene maatregelen.
2. Bij ministeriële regeling kunnen regels worden gesteld met betrekking tot de
samenwerking tussen de ministeries.
§ 3 Structurering werkzaamheden
Artikel 21
1. Ten behoeve van het opstellen van een raming voor de begroting voor een
dienstjaar, bedoeld in artikel 34 van de Comptabiliteitslandsverordening,
stellen de afdelingen en uitvoeringsorganisaties een beleidsplan op met
daaraan gekoppeld de begrote inzet van mensen en middelen per beleidsdoel
of project.
2. Het jaarplan wordt door tussenkomst van de secretaris-generaal aan de
verantwoordelijke minister ter goedkeuring voorgelegd.
3. Aan de hand van de jaarplannen van de afdelingen en de
uitvoeringsorganisaties wordt de raming, bedoeld in het eerste lid, voor het
ministerie opgesteld.
4. De plannen, begrotingen, periodieke rapportages over de voortgang van de
uitvoering en over de afsluiting van het begrotingsjaar worden behandeld in
de ministerraad.
Artikel 22
1. Ter uitvoering van de door de Staten goedgekeurde begroting voor een
ministerie wordt door elke afdeling een activiteitenplan per beleidsveld of
project opgesteld.
2. Over de uitvoering van het activiteitenplan wordt door het afdelingshoofd, dan
wel het hoofd van de uitvoeringsorganisatie periodiek aan de secretaris-
generaal verslag gedaan.
Artikel 23

1. Er is een gestructureerd overleg van de secretarissen-generaal van de
ministeries.
2. Het overleg van de secretarissen-generaal vergadert in beginsel tenminste
éénmaal per twee maanden over aangelegenheden:
a. die voor alle ministeries op soortgelijke wijze van belang zijn, dan wel;
b. die ministerie-overschrijdend zijn, dan wel;
c. de bedrijfsvoering binnen de totale overheidsheidsorganisatie betreffende,
dan wel;
d. het personeelsbeleid- en beheer betreffende, dan wel;
e. overigens, op verzoek van tenminste twee secretarissen-generaal.
3. De secretarissen-generaal treden bij toerbeurt op als voorzitter van het
overleg.
4. De minister-president vergadert tenminste éénmaal per half jaar met het
overleg van secretarissen-generaal. Hij treedt dan op als voorzitter van het
overleg.
5. Iedere minister kan, voor zover het zijn beleidsterrein betreft, het overleg van
secretarissen-generaal bijeen roepen. Alsdan treedt hij op als voorzitter van
het overleg.
6. De werkwijze van het overleg wordt vastgelegd in een reglement van orde dat
op voordracht van de secretaris-generaal van het ministerie van Algemene
Zaken door het overleg wordt vastgesteld.
7. Het secretariaat van het overleg wordt gevoerd door het ministerie van
Algemene Zaken.
§ 4 Slot- en overgangsbepalingen
Artikel 24
Na inwerkingtreding van deze landsverordening berusten de organisatiebesluiten
ter uitvoering van de Organisatieverordening van het eilandgebied Sint Maarten,
op de artikelen 10 en 20 van deze landsverordening, met dien verstande dat in
plaats van “sectoren” wordt gelezen: ministeries.
Artikel 25
Deze landsverordening wordt aangehaald als: de Landsverordening inrichting en
organisatie landsoverheid.

MEMORIE VAN TOELICHTING
1. Algemeen deel
Artikel 38 van de Staatsregeling draagt de wetgever op een landsverordeing vast
te stellen met betrekking tot de instelling van de ministeries die onder
verantwoordelijkheid van een minister staan. Volgens artikel 39, tweede lid, van
de Staatsregeling bestaat de ministerraad uit zeven ministers, tenzij bij
landsverordening een ander aantal is bepaald. Hoewel er niet noodzakelijkerwijze
een causaal verband hoeft te bestaan tussen het aantal ministers en het aantal
ministeries, is vooralsnog het aantal ministers en ministeries gehouden op het
uitgangspunt van de Staatsregeling, namelijk zeven.
Voor de vormgeving is aangesloten bij de Organisatieverordening voor het
eilandgebied Sint Maarten zoals gewijzigd bij Eilandsverordening van 16
december 2009. Hierbij is gerelateerd aan de door het eilandgebied Sint Maarten
vastgestelde Organisatienota van het Land Sint Maarten voor wat betreft de
algemene taken van de ministeries, de algehele structurering van de ministeries
en de bedrijfsvoering ervan. Voor wat betreft de taakstelling van de
onderscheiden ministeries en de structurering van de organisatie van de
ministeries is gelet op de vastgestelde Organisatieplannen van de ministeries van
Algemene zaken, van Financiën, van Justitie, van Onderwijs, Cultuur, Jeugd- en
Sportzaken, van Volksgezondheid, Sociale Ontwikkeling en Arbeid, van Toerisme,
Economische Zaken, Vervoer en Telecommunicatie, en van Volkshuisvesting,
Ruimtelijke Ordening, Milieu en Infrastructuur.
Bij het opstellen van een landsverordening die beoogt een wettelijke basis te
verschaffen aan een overheidsorganisatie doet zich de vraag voor of alleen de
hoofdlijnen en hoofdstructuren van de organisatie in de landsverordening worden
vastgelegd, of dat het gewenst is de organisatie, de taken en de structuren ervan,
in een meer gedetailleerde vorm vast te leggen. Zo heeft de wetgever van de
Nederlandse Antillen ervoor gekozen in de Landsverordening organisatie
landsoverheid gewenste personeelsformaties voor de verschillende ministeries op
te nemen en aan deze personeelsformaties in de landsverordening een maximum
te verbinden. Aldus wordt bereikt dat een minister niet zonder instemming van de
Staten de formatie van zijn ministerie kon uitbreiden en extra personeel kon
benoemen.
In dit ontwerp inrichting en organisatie landsoverheid Sint Maarten is ervoor
gekozen alleen de hoofdlijnen, de hoofdtaken, de hoofdstructuren en de
belangrijkste elementen van de bedrijfsvoering van de verschillende ministeries in
de landsverordening op te nemen. Wel voorziet het ontwerp erin dat detaillering
van de taakstelling van de organisatieonderdelen van de ministeries, een meer
gedetaileerde structurering e.d., mogelijke gewenste personeelsformaties en een
maximum daarvan bij landsbesluit, houdende algemene maatregelen of een
ministeriële regeling worden uitgewerkt.
Het land Sint Maarten krijgt een nieuwe landsoverheidsorganisatie die vorm heeft
gekregen rond de integratie van oude eilandelijke taken en nieuwe landstaken.
Dat betekent dat in de beginjaren van de landssatus de organisatie nog
regelmatig zal moeten worden aangepast, bijgesteld, veranderd. Om de
noodzakelijke slagvaardigheid te waarborgen in deze organisatie-aanpassingen
zijn geen details op de verschillende hoofdelementen van de organisatie (taken,
structuren, bedrijfsvoering) in de landsverordening opgenomen. Immers als dat
wel het geval is, zoals dat is gebeurd in de Nederlands-Antilliaanse
Landsverordening organisatie Landsoverheid, dan zal voor elke detailwijziging in
de organisatie of de personeelsformatie ervan, een wetswijziging moeten worden

geëntameerd. Zonodig kan op termijn alsnog worden overgegaan tot een meer
gedetailleerde regeling bij landsverordening.
2. Bijzonder deel
Artikelen 1 tot en met 10
In de eerste paragraaf van de landsverordening wordt hoofdstructuur van de
ambtelijke organisatie van de overheid van het land neergelegd. De organisatie
bestaat vooralsnog uit zeven ministeries. In de hoofdstructuur van de ministeries
is uitgegaan van een scheiding tussen enerzijds beleidsvoorbereiding,
beleidsformulering en beleidsvaststelling en anderzijds de uitvoering van beleid.
Tevens wordt uitgegaan van de inrichting van shared support services. Dit is een
modern organisatieprincipe waarmee snelle en duidelijke procedures worden
bereikt op het gebied van een aantal diensten en producten die nodig zijn voor
alle ministeries.
De hoofdstructuur wordt verder uitgewerkt door de verschillende organisatorische
eenheden te identificeren en nader uit te werken op hoofdlijnen. Tevens worden
de verantwoordelijkheden van de verschillende sleutelfuncties neergelegd.
Artikelen 11 tot en met 20
In de tweede paragraaf wordt aan de hand van de doelstellingen van de
ministeries nadere uitwerking gegeven aan de hoofdstructuur.
Het ministerie van Algemene Zaken wordt in het bijzonder belast met de
ondersteuning van de overige ministeries op gebied van de shared services.
Onderhavige landsverordening bevat in artikel 10 een delegatie aan de regering
om de kwaliteit en kwantiteit van de formatie te regelen bij landsbesluit,
houdende algemene maatregelen. Dit betreft de vaststelling van de functieboeken
voor elke organisatie onderdeel.
Nadat ervaring met het functioneren van de ministeries zal zijn opgedaan en de
taakstelling van de verschillende organisatieonderdelen enigermate zal zijn
uitgekristallisseerd, zal opnieuw kunnen worden bezien of de uitwerking van de
taken in alle gevallen voldoet.
Artikelen 21 tot en met 23
In de derde paragraaf wordt de werkwijze van de organisatie onderdelen in
hoofdlijnen uitgezet. Daarbij staat centraal de aansluiting tussen de planning van
de organisatie en de begrotingscyclus. Zonder middelen kan er immers geen
beleid worden uitgevoerd en zonder planning en controle is het niet mogelijk om
gedegen verantwoording af te leggen omtrent de besteding van de middelen.
Met het oog hierop wordt uitdrukkelijk verwezen naar artikel 34 van de
Comptabiliteitslandsverordening, waarin de tijdlijn wordt uitgezet voor de
voorbereiding van de begroting.
Ter bevordering van de eenheid in beleid zijn twee instrumenten opgenomen. Ten
eerste de mogelijkheid om ingevolge artikel 20, tweede lid, bij ministeriële
regeling de samenwerking tussen ministeries te regelen. Dit kan ad hoc zijn voor
een bepaald project of structureel gelet op de raakvlakken tussen twee of meer
ministeries.
In artikel 23 is het tweede instrument neergelegd, namelijk het gestructureerd
overleg van de secretarissen-generaal. Dit overleg is vergelijkbaar met het
management team overleg binnen de eilandelijke overheidsstructuur. Ter
ondersteuning van een ordentelijk verloop van het overleg is het secretariaat

neergelegd bij het ministerie van algemene zaken. Dit strijdt niet met het
roulerend voorzitterschap van het overleg. Tevens zal het overleg een reglement
moeten vaststellen ter regeling van de werkzaamheden. Een voorstel daartoe
wordt door de secretaris-generaal van het ministerie van algemene zaken
gedaan.
In de laatste paragraaf is een belangrijke voorziening opgenomen. Artikel 24
regelt het voortbestaan van de organisatiebesluiten gegeven op basis van de
Organisatieverordening van het eilandgebied, zoals gewijzigd bij
Eilandsverordening van 16 december 2009, waarbij de organisatie is aangepast
voor de ontvangst van de te decentraliseren landstaken. Deze
organisatiebesluiten houden tevens in de vaststelling van de functieboeken
conform de nieuwe organisatiestructuur voor het Land Sint Maarten. Zodoende is
een vloeiende overgang van de ambtelijke organisatie van de structuur van het
eilandgebied naar de structuur voor het Land gewaarborgd.
