2. Kanunun amaç ve kapsamı; içerik
sağlayıcı, yer sağlayıcı, erişim sağlayıcı ve
toplu kullanım sağlayıcıların yükümlülük
ve sorumlulukları ile internet ortamında
işlenen belirli suçlarla içerik, yer ve erişim
sağlayıcıları üzerinden mücadeleye ilişkin
esas ve usulleri düzenlemektir.
3. 5651 sayılı kanun ve ilgili
Telekomünikasyon Kurumu yönetmeliği
her kurum için bazı yükümlülükler
getiriyor.
Kanunun ve yönetmeliğin birçok konuda
net tanım yapmadığını söylememiz yanlış
olmayacaktır.
4. Kanun çerçevesinde tüm kurumlar Toplu
Kullanım Sağlayıcı olarak değerlendirilmektedir
ve kanunun yedinci maddesi ikinci fıkrası gereği
tüm kurumlar, sekizinci maddede tanımlanmış
konusu suç olan içeriğe sahip web sitelerine
erişimi engelleyici tedbirler almakla yükümlüdür.
İlgili tedbirlerin tanımı kanunda veya
yönetmelikte net olarak belirtilmese de
beklenen tedbir her kurumun bir URL Filtering
(filtreleme) çözümü kullanmasını zorunlu
kılmaktadır. Ayrıca tüm kurumlar iç IP dağıtım
kayıtlarını saklamakla yükümlüdür.
5. Hosting şirketleri ve kendi web sunucusunu
barındıran tüm kurumlar kanunda Yer Sağlayıcı
olarak değerlendirilmektedir. Kanun gereği
kendi web sunucusunu barındıran
firmalar/kurumlar ve hosting şirketleri Faaliyet
Belgesi almakla yükümlüdür. Yine bu şirketler
Web, Ftp ve Smtp sunucusuna gelen/giden
trafiğin bilgilerini altı ay boyunca saklamak ve
oluşan verilerin bütünlük değerlerini (hash)
zaman damgası ile birlikte saklamak ve gizliliğini
temin etmekle yükümlüdür. Bu bilgiler kaynak ip
adresi, hedef ip adresi, istenilen url, saat, tarih
ve komut detayları (http get/post) olarak
tanımlanmıştır.
6. Kanunun dördüncü maddesine göre
Web sitesi bulunan her şirket artık site
içeriğinden sorumlu olacaktır.
7. MADDE 243
(1) Bir bilişim sisteminin işleyişini engelleyen
veya bozan kişi, bir yıldan beş yıla kadar
hapis cezası ile cezalandırılır.
(2) Bir bilişim sistemindeki verileri bozan, yok
eden, değiştiren veya erişilmez kılan,
sisteme veri yerleştiren, var olan verileri
başka bir yere gönderen kişi, altı aydan üç
yıla kadar hapis cezası ile cezalandırılır.
8. (3) Bu fiillerin bir banka veya kredi kurumuna
ya da bir kamu kurum veya kuruluşuna ait
bilişim sistemi üzerinde işlenmesi halinde,
verilecek ceza yarı oranında artırılır.
(4) Yukarıdaki fıkralarda tanımlanan fiillerin
işlenmesi suretiyle kişinin kendisinin veya
başkasının yararına haksız bir çıkar
sağlamasının başka bir suç oluşturmaması
hâlinde, iki yıldan altı yıla kadar hapis ve
beşbin güne kadar adlî para cezasına
hükmolunur.
9. MADDE 245
(1) Başkasına ait bir banka veya kredi
kartını, her ne suretle olursa olsun ele
geçiren veya elinde bulunduran kimse,
kart sahibinin veya kartın kendisine
verilmesi gereken kişinin rızası olmaksızın
bunu kullanarak veya kullandırtarak
kendisine veya başkasına yarar sağlarsa,
üç yıldan altı yıla kadar hapis cezası ve
adlî para cezası ile cezalandırılır.
10. (2) Sahte oluşturulan veya üzerinde
sahtecilik yapılan bir banka veya kredi
kartını kullanmak suretiyle kendisine veya
başkasına yarar sağlayan kişi, fiil daha
ağır cezayı gerektiren başka bir suç
oluşturmadığı takdirde, dört yıldan yedi
yıla kadar hapis cezası ile cezalandırılır.
11. AMAÇ: Bu Kanunun amacı, fikir ve sanat
eserlerini meydana getiren eser sahipleri ile
bu eserleri icra eden veya yorumlayan
icracı sanatçıların, seslerin ilk tespitini yapan
fonogram yapımcıları ile filmlerin ilk tespitini
gerçekleştiren yapımcıların ve radyo-televizyon
kuruluşlarının ürünleri üzerindeki
manevi ve mali haklarını belirlemek,
korumak, bu ürünlerden yararlanma
şartlarını düzenlemek, öngörülen esas ve
usullere aykırı yararlanma halinde
yaptırımları tespit etmektir.
12. KAPSAM: Bu Kanun, fikir ve sanat eserlerini
meydana getiren eser sahipleri ile bu
eserleri icra eden veya yorumlayan icracı
sanatçıların, seslerin ilk tespitini yapan
fonogram yapımcıları ile filmlerin ilk tespitini
gerçekleştiren yapımcıların ve radyo-televizyon
kuruluşlarının ürünleri üzerindeki
manevi ve mali haklarını, bu haklara ilişkin
tasarruf esas ve usullerini, yargı yollarını ve
yaptırımları ile Kültür Bakanlığının görev,
yetki ve sorumluluğunu kapsamaktadır.
