1) The petitioner filed a habeas corpus petition challenging the detention order of Sukumar Das under the Prevention of Illicit Traffic in Narcotic Drugs and Psychotropic Substances Act, 1988. 2) It was found that over 8 months after the initial detention order, no order confirming detention had been issued by the state authorities, in violation of Article 22(4) of the Indian Constitution. 3) The court declared further detention of Sukumar Das to be illegal and ordered his immediate release. The state was also directed to pay him compensation of Rs. 50,000 for over 4 months of illegal detention.
