No tax advice relies for its effectiveness on the Bangladesh tax authority (NBR) having less than the relevant facts. Please be advised that Sandra & Associates gives includes consideration of, and is based on the assumption that the client will make relevant disclosures that both comply with the law and enable tax authorities to make further enquiries should they wish to do so. Tax advice is given in the context of the specific facts and circumstances as provided by the client concerned and is appropriate to those facts and circumstances. Above all else, in every respect our work shall be fully compliant with relevant legal, regulatory and professional requirements. We do not promote artificial tax planning structure. We do assist our clients with planning their tax affairs in relation to their business and commercial transactions. We shall explain clearly and objectively to our clients the technical merits and the sustainability of any tax advice we give. We believe in full disclosure and transparency over our clients’ and our own positions. We always comply with all our disclosure requirements and advise our clients to do the same. When advising clients on entering into transactions we shall do so on the understanding that all material facts will be known to the tax authorities. We only advise clients on tax arrangements where we have a high degree of confidence that our view is correct and would prevail in the Court. It is impossi- ble to predict entirely the interpretations that the tax authorities and the Court will make and therefore aware our clients of risk as part of our advice. Where we are aware that we are advising on an era of the law that is quite uncertain or likely to be the sub- ject of litigation, we will bring this to our client’s attention and recommend conclusion with legal counsel. We never advise clients to enter into transactions with the purpose of securing a tax advantage clearly and unambiguously contrary to the relevant legislation and shall not assist them to implement such transactions. If, in our view, the language of the legislation is uncertain, we shall consider the intention of the relevant legislators In giving advice, we always consider the specific facts and circumstance related to each client’s own position. We only advise clients to enter into, or assist them to implement, transactions or arrangements on the basis that they have any substance required by law, as well as any business, commercial or other non-tax purpose re- We always consider wider risks and circumstances relating to each client and the possible implications of the course of actions we are considering.
