This unpublished opinion from the Idaho Court of Appeals, filed February 4, 2026, addresses Docket No. 52552 in the case of DPW Enterprises LLC and Mountain Prime 2018 LLC v. Jeremy L. Bass. The appeal arises from a post-foreclosure ejectment action following the non-judicial foreclosure sale of residential property located at 1515 21st Avenue, Lewiston, Idaho. DPW purchased the property for $165,346.71 as the sole bidder, and the trustee's deed was recorded in Nez Perce County. DPW then initiated ejectment proceedings after Bass and tenant Dwayne Pike refused to vacate.
Bass raised numerous arguments at the district court level, including claims of bid manipulation, collusion, Sherman Antitrust Act violations, forgery of the 2009 deed of trust, fraudulent instruments, conflicts of interest involving the mortgage servicer Carrington Mortgage Services, and improper service of eviction notices. Bass also asserted nine affirmative defenses and filed multiple motions including motions to dismiss, strike, and for judicial admonishment.
The Court of Appeals, in an opinion authored by Judge Huskey with Judges Gratton and Lorello concurring, first determined the appeal was not moot despite the executed writ of restitution, distinguishing several cases cited by DPW. On the merits, the court affirmed that DPW established itself as a bona fide good faith purchaser under the Idaho Trust Deeds Act, that no genuine issue of material fact existed regarding ownership, and that Bass failed to support his allegations with evidence beyond conclusory assertions. The court declined to consider arguments raised for the first time on appeal, including a judicial disqualification claim based on the district judge having presided over Bass's divorce.
The court found Bass's appeal was brought frivolously, unreasonably, and without foundation under Idaho Code Section 12-121, awarding attorney fees and costs on appeal to DPW in addition to affirming the district court's fee award of $9,626.91.
