3. REGISTER SHOULD CONTAIN
NOTE OF

REMOVAL OF ESTATE,
REDEMPTION, AND
RELINQUISHMENT
4. CLASSES OF PERSONS ENTITLED TO
PRAY FOR REGISTRATION
u/s 50 of the Act:
Succeeding to estate
Joint proprietor/land holder assuming charge
Assuming charge as a manager
Mortgagee obtaining possession
Title and possession both needed for
mutation (gaya prasad vs assam board of revenue)
5. OBLIGATION TO PRAY FOR
REGISTRATION
The classes of person in earlier slide within 6 months
of their possession shall apply to DC for registration
(u/s 50)
If anyone omits to do so voluntarily
or negligently, fine of 5 times of registration fee and
even daily fine of Rs. 1 per day and to be subject to all
liabilities (u/s 58)
6. PROCEDURE ON RECEIPT OF
APPLICATION (OFFICE MUTATION)
DC within 1 month to call for general notice and copy
to be given to all the parties (u/s 52)
If any objection arise than enquiry is to be conducted
and passes an order for registration (u/s 53)
7. FIELD MUTATION/ CHITHA
MUTATION/ SUMMARY MUTATION
It is done on own initiative of DC
DC got the information and it is verified by local
enquiry by officer not below rank of Assistant
Settlement Officer (ASO)
Notice has been published by enquiry following the
steps involved u/s 52 and 53
ASO can do it during field tour as the heading suggest
Objection can be filed within 3 years , and office
mutation needs to be followed
8. PUBLIC CAN INSPECT REGISTER
AND APPLY FOR ITS EXTRACT
Section 60 prescribes fee and the rules
The person shall not take pen or ink
in record room, shall not alter or erase any record, not
to remove register but can take notes of these in
presence of record keeper and fee of rs. 1 to be leviable
in court fee stamps for inspection
