Property owners in the State of Florida are divided into two classes.
There are people who have homesteads and there are investors.
In order to build wealth and fortune out of the buying, selling, renting or trading of Florida property one must understand the difference between the way homestead property and investment property is treated here in Florida. And to do that, we have to take a brief trip to England about 500 years ago. If you bear with me for this history lesson it will become clear to you how investment in Florida property the right way can build wealth and cash flow for you. I’m Nicola Chin.

500 years ago in England, During the Reign of Henry the VIII , HERE is the way society thought property ownership worked:
The King got his rules from God, The King gave land to his friends, who were called Barons or “Land Lords” and the “Land Lords” gave space on the Land to “Tenants’ who worked the land for food. A portion of what the Tenants grew, harvested and sold was passed back of to the King as Taxes.
This was the “Feudal System” and it worked fine for the wealthy ‘friends of the King’ and the King, but it wasn’t that good a deal for the tenants. In fact, even the Land Lords had a problem with the system after a while so they did something about it. What they did was called a Land Trust.
You see, in order to keep the land that the Kings passed over to family and friends, the Land Lords also had to send their children, heirs, and workers off to fight the Kings wars.
If they didn’t want to do that or if they didn’t send the King enough taxes, the King could simply take their land away and give it to someone else. In 1536 England’s Land Lords passed a law called the Land Trust to stop the King from taking their children off to war and used it to keep the king from taking their land away from them. It worked for two years….
In 1538 King Henry put an end to Land Trusts with a law called the Statute of Uses.
It overthrew the Land Trust law. The King’s new Law said that when land is placed into a “Land Lord’s”’ name for the use of his heirs, the Land Lord again became the owner of the property. The new law gave Henry the right to seize a landowners property just like it had been before. That strange law came to the Colonies of the new world with British rule. More important it stayed part of the United States laws when the US broke away from England.
In Florida the Statute of Uses is known as Florida statues 689.09 and it means the same thing. It means that if you don’t pay taxes to the State of Florida, you can lose your property.
OK, now fast forward with us to 1963. The Disney Company wanted to build a resort near the town of Orlando in Central Florida, but they knew that if the word got out that they wanted to buy about 15 different tracts of land outside of town, speculators would drive the price of that land through the ceiling.
The disney lawyers went to the Florida Legislature and urged, then accomplished the adoption of a new law called the Florida land Trust Act. It was modeled after a similar law in Illinois.
The law allowed three things to happen with Florida Land.
Privacy of Ownership, Protection against Liability and Negotiation without disclosure. Fourteen Land Trusts were created by Disney lawyers and each land Trust bought a tract of land All the lands were contiguous. The planet now knows that place as Disney World.
Investors in Florida Property know that Law as their ticket to wealth.
Now, as we said at the beginning, Florida has two kinds of land owners, “Homesteaders” and Investors.
