3. CAPACITY OF PARTIES
• According to Sec.11 of the Indian Contract Act, 1872,
• Every person is competent to contract, who is
• Of the age of majority according to the law to which he is
subject
• Of sound mind and
• Not disqualified from contracting, by any law to which he is
subject.

5. 1. MINORS
• According to the Indian Majority Act, 1875, a
minor is one who has not completed his or
her 18th year of age.
• There are 2 exceptions:
• When a guardian of a minor or his
property is appointed by a court of law
and
• When a minor’s property is taken over by
the court of wards for management.
