• Vanuit El

ers’ “frequentistisch” opleiding mocht hij die vraag niet
beantwoorden. In plaats daarvan berekende hij de kans op zoveel
incidenten als Lucia had meegemaakt, als elke dienst,
onafhankelijke van elkaar, precies dezelfde kans had om een
incident te bevatten
• Die kans becijferde hij op 1 op 324 miljoen
• Lucia werd schuldig bevonden

The case of the Dutch nurse formerly known as “Lucia de B.” starts with three 2 ⇥ 2 table

Between November 2020 and September 2021 (when police investigations started) on

Moordaanslag op premier Hariri, 2005
Leden van een terroristische cel gebruiken tal van anonieme mobiele telefoons om met
elkaar te communiceren. Hun leiders gebruiken ook enkele “openbare” mobiele
telefoonnummers voor zakelijke en familieaangelegenheden. De anonieme telefoons worden
gebruikt op locaties en tijden die verband lijken te houden met de aanslag op premier Hariri.
Het lijkt alsof steeds met verschillende telefoons gebeld wordt door dezelfde persoon
tijdens meerdere verdachte reizen. Aanklager: meerdere telefoons worden gebruikt door
dezelfde personen: de aangeklaagden. Verdediging: de anonieme telefoons zijn van
onbekende, andere personen. De coïncidenties zijn toevallig.

Inquisitorial vs adversarial in criminele rechtspraak
“Inquisitorial”: rechters voeren een onderzoek uit om
feiten te bepalen en juridische consequenties ervan te
bepalen
“Adversarial”: de twee partijen presenteren hun
meningen aan een jury; de rechter is scheidsrechter;
de jury bepaalt of en zo ja welke misdaden gepleegd
zijn en de rechter leidt daaruit de juiste straf

23. What are the big problems?
The prosecution is not introducing any statistical analysis “because that only
confuses people”
AFAIK the defence won’t either
The prosecution is arguing there is an overwhelmingly obvious pattern; but
the pattern (IMO) could well be manufactured by cherry-picking at all levels:
first of events; then of the medical interpretation of the events; finally of the
interpretation of the manner in which LL reacts to events.
NB the hospital doctors and administrators and fellow nurses who provide the
evidence are not independent witnesses. Possibly they could even be
suspects. That whole community has collectively decided years ago that LL is
a serial killer
24. • Voordeel van onze “inquisitoriele” systeem: de rechtbank moet
een publiek schriftelijk verslag van zijn overwegingen publiceren
• Het “ketting bewijs” gebruikt bij Lucia de B is logisch en goed
doordacht. De verdediging hoeft dan alleen de eerste steen
omver te gooien – dan stort de hele constructie in
• Ook bij Daniela Poggiali was het voldoende om één steen omver
te werpen, bij elk van de twee moorden waarvoor ze veroordeeld
was
