Česká republika je malý, vysoce regulovaný trh v rámci zemí Evropské unie. Nedávno se začaly objevovat obavy ohledně dostupnosti některých nepostra-
datelných léčiv. V České republice je registrováno celkem 58 217 variant léčivých přípravků, z nichž 8 157 (14 %) je v současné době aktivně obchodováno.
Důvody neochoty zavést přípravky po registraci na trh jsou mimo jiné komplikovaná národní legislativa, netransparentní a nekonzistentní vymáhání práva,
nepředvídatelnost administrativních postihů, nejednoznačná pravidla pro vyjednávání cen a posuny v postupech v závislosti na politických změnách.
Ačkoliv je současná situace dávána za vinu reexportům, žádná vyčerpávající studie o rozsahu a původu nedostatku léků neexistuje. Analýza Arete‑Zoe
srovnává počty registrovaných a obchodovaných léčivých přípravků dle indikačních skupin a poskytuje vhled do dostupnosti léčiv v České republice ze se-
znamu nepostradatelných léčiv Světové zdravotnické organizace (WHO). Údaje pocházejí z databáze Státního ústavu pro kontrolu léčiv. Vizualizace dat
ukazují vysoké zastoupení v některých terapeutických oblastech (neurologie a psychiatrie, kardiovaskulární léky), zatímco jiné skupiny jsou zastoupeny jen
stěží. Z celkového počtu 427 nepostradatelných léčiv ze seznamu WHO je jich v současné době v České republice nedostupných 135. Nejhůře jsou na tom
antiinfektiva, antiparazitika a dermatologika. Nedostatek některých nepostradatelných léčiv, specificky injekčních přípravků a starších léčiv, jimž vypršela
patentová ochrana, je globálním problémem. Příčiny jsou komplexní, mj. konsolidace průmyslu, potíže při výrobě, zadávání výroby do produkce výrobcům
v Číně a Indii, administrativní postihy vůči výrobcům pro nedodržení zásad Správné výrobní praxe, nedostupnost zdrojových materiálů, obchodní bariéry,
případně ukončení výroby z ryze obchodních důvodů. Zpráva Úřadu pro odpovědnost vlády (GAO) z července 2016 podrobně zkoumá příčiny nedostatku
léčiv ve Spojených státech amerických a navrhuje řešení na národní úrovni. Zdravotnické systémy mají často potíže definovat, jaké jsou potřeby jejich
populace. Zároveň nemocnice jsou velmi omezeny v možnostech volby a musejí nakupovat pouze s ohledem na cenu. Světová zdravotnická organizace
ve své zprávě (2016) navrhuje minimální garantované ceny pro určité nepostradatelné léky, aby byla zaručena jejich dostupnost v přijatelné kvalitě.

Konzultační společnost Arete‑Zoe, LLC,
poskytuje celé spektrum služeb v oblasti
řízení rizika a optimalizace procesů v obo‑
ru zdravotnictví a farmaceutického prů‑
myslu. Tato činnost zahrnuje analýzu pro‑
cesů, sběr a zpracování informací, produkci

jsme se měli možnost podílet.
V České republice je aktuálně registro‑
váno 58 217 variant léčivých přípravků,
tj. včetně všech lékových forem, sil a ve‑
likostí balení. Z těchto více než 58 000 lé‑
kových variant jich bylo v posledním
čtvrtletí roku 2016 aktivně obchodová‑
no pouze 8 157 (14 %). O registrace léčiv
na českém trhu je dle vyjádření Státního
ústavu pro kontrolu léčiv (SÚKL) značný
zájem, avšak rozhodnutí o tom, zda bude
registrovaný léčivý přípravek pacientům
skutečně dostupný, je na držiteli rozhod‑
nutí o registraci.
Počet registrovaných léčiv v České re‑
publice, která ovšem nejsou na trhu, nyní
dosahuje 50 000. Vzhledem k tomu, že
v případě nutnosti je možno převzít re‑
gistraci z jiné země EU [4], není prosté
neuvedení na trh po registraci a násled‑
ná nedostupnost ještě důvodem k panice.
Otázkou ovšem je, zda takový postup pro
případ krize je tím nejlepším a nejekono‑
mičtějším řešením.
Česká republika je malý trh, navíc
s komplikovanými pravidly, často od‑
lišnými od zemí Evropské unie (EU).
Pravidla pro vymáhání předpisů nejsou
vždy vnímána jako transparentní. Jedním
z nejdůležitějších vodítek pro manažery
rizika v oboru je historie vymáhání prá‑
va, konzistence administrativních postihů
vůči různým subjektům, předvídatelnost
chování státní správy a pravděpodobnost
ovlivnění státní administrativy politickými
změnami a náladami v zemi. Zářným pří‑
kladem je matoucí používání standardní
terminologie „qualified person“ (kvalifiko‑
vaná osoba) a „responsible person“ (odpo‑

vědná osoba) a definice jejich kompetencí,
rolí v oblasti distribuce léčivých přípravků
a postavení v organizační struktuře spo‑
lečnosti [5].
Dalším příkladem je inspekce ve skla‑
du léčiv v Rudné v lednu 2017, jejíž výsle‑
dek je k dispozici k nahlédnutí v databázi
EudraGMDP. Tento nález pouze odkazuje
na článek 84 směrnice 2001/83/EC, který
pouze přikazuje implementaci Pokynu pro
správnou distribuční praxi. Dokument je
navíc na internetu označen stále jako dů‑
věrný [6].
Transparentnost v oblasti postihů je
jednou ze základních podmínek fungo‑
vání státní správy. Například americký
Úřad pro potraviny a léky (Food and Drug
Administration, FDA) na svých stránkách
publikuje dopisy kontrolovaným subjek‑
tům [7]. Odborná veřejnost má možnost
si všechny tyto dopisy stáhnout a podrob‑
ně je prozkoumat. Pro farmaceutický prů‑
mysl, ale i pro investory je důležité vědět,
jakým způsobem úřady řeší standardní si‑
tuace, zda měří všem stejně a zdali a jakým
způsobem je možno se bránit nekalým ob‑
chodním praktikám, včetně korupce [8].
Právně‑administrativní nejistota, nejasná
forma tvorby cen a netransparentní pro‑
středí může řadu farmaceutických společ‑
ností od uvedení léčiv na český trh odradit.
Problematice dostupnosti léčiv věnují
česká média pozornost již velmi dlouho
[9]. Současná situace je kladena za vinu
zpětnému vývozu, ale i nastavení cen léči‑
vých přípravků v ČR ve srovnání se zbyt‑
kem Evropy. Studii o aktuální situaci, ana‑
lýzu příčin současného stavu, srovnání se
situací ve světě a návrhy řešení jsem ovšem
nenašla. Podrobná studie by měla sloužit

jako jeden z podkladů pro přípravu novely
zákona o léčivech.
Prvním krokem k usměrnění debaty
na dané téma je upřesnění toho, která lé‑
čiva na českém trhu jsou a která chybějí
a z jakého důvodu tomu tak je.
Analýza dat provedená naší společnos‑
tí [10] porovnává celkový počet registrací
a počet obchodovaných registrací na čes‑
kém trhu, a rovněž dostupnost léčiv na čes‑
kém trhu se seznamem nezbytných léčiv
Světové zdravotnické organizace (World
Health Organization, WHO), tab. 1,
graf 1−3 [11]. Z vizualizací je zřejmé, že
některým léčivým látkám se dostává ne‑
bývalé pozornosti: vítězem s nejvyšším
počtem 1 190 registrací (48 obchodova‑
ných) se stal pregabalin, lék určený k léč‑
bě úzkostných stavů, neuropatické bolesti
a záchvatů. O tento lék je taktéž značný
zájem na černém trhu. Nejpočetněji za‑
stoupenými lékovými skupinami jsou pří‑
pravky pro nervový systém a dále pak
léky pro onemocnění srdce a cév (graf 2).
V jiných oborech je výběr a dostupnost
léčiv nepoměrně chudší. Příkladem jsou
dermatologika, antimikrobiální léčiva –
obzvláště pro léčbu mykobakterií, anti‑
virové přípravky, séra, imunoglobuliny
a vakcíny, některé skupiny onkologických
léčiv, imunosupresiva, anestetika a další.
Nejméně jsou na českém trhu zastoupena
antiparazitika: z celkem 21 registrací pro
celou indikační skupinu jich v posledním
čtvrtletí loňského roku bylo obchodova‑
ných jen sedm.
Seznam všech 427 nepostradatelných
léčiv je možno nalézt v příloze 3 technické
zprávy WHO [12]. Z těchto nenahraditel‑
ných léčiv jich v současné chvíli v České
republice chybí 135 (tj. 32 %). Nejhůře jsou
dotčena antiinfektiva (ze 119 nepostrada‑
telných jich chybí 39), dermatologika (z cel‑
kem 21 nepostradatelných chybí 12) a již
zmíněná antiparazitika (z 36 nepostradatel‑
ných chybí 30). Podrobný rozbor dle orgá

Nedostatek základních léčiv, a přede‑
vším infuzních a injekčních látek, není
problémem pouze v České republice. Far‑
maceutický průmysl se od osmdesátých let
dvacátého století podstatně změnil: farma‑
ceutické společnosti se v důsledku vzájem‑
ného slučování rozrůstají [13] a řada funkcí
je zadávána subdodavatelům v levnějších
regionech převážně v Asii [14]. Globaliza‑
ce s sebou přináší řadu změn, od možnosti
získat levné zboží z druhého konce světa
po nutnosttotozbožíz druhéhokoncesvěta
dovézt a taktéž dohlédnout na jeho přijatel‑
nou kvalitu [15]. V tomto směru je nejvíce
aktivní FDA, který aktivně kontroluje in‑
dické a čínské výrobce léčiv, než se jejich
produkty dostanou na americký trh [16];
FDA také vede databázi léčiv, která na trhu
chybějí[17],a každoročněpřipravujezprávu
pro Kongres [18]. V červenci 2016 pak Úřad
pro zodpovědnou vládu (GAO) vydal roz‑
sáhlou zprávu o příčinách nedostatku léčiv
a způsobech dosažení nápravy [19].
V lednu 2016 vydala WHO zprávu [20],
jakým způsobem je možno řešit nedostatek
některých léků, a to jak ve vyspělých, tak
v rozvojových zemích. Nedostatek posti‑
huje především léčiva starší, s prošlými
patenty, ovšem s náročným výrobním po‑
stupem. Příčiny jsou různé: zejména potíže
se získáním chemických materiálů pro vý‑
robu a problémy ve výrobě, omezený počet
výrobců některých zdrojových chemikálií,
administrativní opatření proti výrobci, a to
především ze strany FDA proti výrobcům
v Indii a Číně, a obchodní překážky bránící
přístupu na trh. Řada starších léčiv je vý‑
robci opuštěna z ryze obchodních důvodů.
Novější léčiva ve stejné indikační skupině
jsou výnosnější, byť ne vždy opodstatně‑
ná pro všechny skupiny pacientů. Studie
z různých zemí jmenují nové technologie
jako jednu z důležitých příčin nedostatku
některých léčiv [21].
Bohužel, zdravotnické systémy ve vy‑
spělých zemích, a tím spíše ne v zemích
chudších, mají potíže definovat, jaká léčiva
a v jakém množství jejich populace potře‑
bují. V mnoha zemích nemocnice nakupu‑
jí na základě nejnižší možné nabídky, bez
možnosti výběru zdroje, distributora, ces‑
ty a způsobu dodání, kvality zabezpečení
dodavatelského řetězce a bez přihlédnutí
k dalším kritériím. Relativně nízký objem
dodávek objednávaných na poslední chvíli
v relativněmalýchmnožstvíchv kombinaci
s neustálýmtlakemna cenučiníz některých
nepostradatelných léčiv ztrátové produkty.
Kroměnotifikačníchsystémůa globálnída‑
tabázeléčivohroženýchnedostatkemdopo‑
ručuje WHO taktéž dohodu minimálních
cen pro určité produkty, aby byla zajištěna
jejich dostupnost v přiměřené kvalitě.

Česká republika je malý, vysoce regulovaný trh v rámci zemí Evropské unie. Nedávno se začaly objevovat
obavy ohledně dostupnosti některých nepostra- datelných léčiv. V České republice je registrováno celkem 58 217
variant léčivých přípravků, z nichž 8 157 (14 %) je v současné době aktivně obchodováno. Důvody neochoty
zavést přípravky po registraci na trh jsou mimo jiné komplikovaná národní legislativa, netransparentní a
nekonzistentní vymáhání práva, nepředvídatelnost administrativních postihů, nejednoznačná pravidla pro
vyjednávání cen a posuny v postupech v závislosti na politických změnách. Ačkoliv je současná situace dávána za
vinu reexportům, žádná vyčerpávající studie o rozsahu a původu nedostatku léků neexistuje. Analýza Arete‑Zoe
srovnává počty registrovaných a obchodovaných léčivých přípravků dle indikačních skupin a poskytuje vhled do
dostupnosti léčiv v České republice ze seznamu nepostradatelných léčiv Světové zdravotnické organizace (WHO).
Údaje pocházejí z databáze Státního ústavu pro kontrolu léčiv. Vizualizace dat ukazují vysoké zastoupení v
některých terapeutických oblastech (neurologie a psychiatrie, kardiovaskulární léky), zatímco jiné skupiny jsou
zastoupeny jen stěží. Z celkového počtu 427 nepostradatelných léčiv ze seznamu WHO je jich v současné době v
České republice nedostupných 135. Nejhůře jsou na tom antiinfektiva, antiparazitika a dermatologika. nedostatek
některých nepostradatelných léčiv, specificky injekčních přípravků a starších léčiv, jimž vypršela patentová
ochrana, je globálním problémem. Příčiny jsou komplexní, mj. konsolidace průmyslu, potíže při výrobě, zadávání
výroby do produkce výrobcům v Číně a Indii, administrativní postihy vůči výrobcům pro nedodržení zásad
Správné výrobní praxe, nedostupnost zdrojových materiálů, obchodní bariéry, případně ukončení výroby z ryze
obchodních důvodů. Zpráva Úřadu pro odpovědnost vlády (GaO) z července 2016 podrobně zkoumá příčiny
nedostatku léčiv ve Spojených státech amerických a navrhuje řešení na národní úrovni. Zdravotnické systémy mají
často potíže definovat, jaké jsou potřeby jejich populace. Zároveň nemocnice jsou velmi omezeny v možnostech
volby a musejí nakupovat pouze s ohledem na cenu. Světová zdravotnická organizace ve své zprávě (2016)
navrhuje minimální garantované ceny pro určité nepostradatelné léky, aby byla zaručena jejich dostupnost v
přijatelné kvalitě.

Valdova V. How is the situation concerning drug availability in the Czech Republic? Remedia 2017; 27: 1–4.
Czech Republic is a small, highly regulated EU market. Recently, concerns emerged regarding
availability of certain essential medicines. There are 58 217 variants of medicinal products registered in
the Czech Republic, of which 8 157 (14%) are currently actively marketed. Reasons for reluctance to
launch products after approval include complex national regulations, lack of transparency and
inconsistent enforcement, unpredictability of administrative actions, ambiguity in price negotiations, and
policy shifts in response to political changes. Although the current situation is mainly blamed on
re‑exports, there is no comprehensive study of the extent and nature of the shortages. Arete‑Zoe analysis
compares numbers of approvals and marketed drugs by indication groups, and provides insight into the
availability of World Health Organization (WHO) essential medicines in the Czech Republic. The dataset
was obtained from the Czech Institute of Drug Control. Data visualizations show high representation in
some therapeutic areas (neurology and psychiatry, cardiovascular drugs), whilst other groups are hardly
present at all. Of the 427 WHO essential medicines, 135 are currently unavailable in the Czech Republic.
The worst affected groups are anti‑infectives, anti‑parasitics and dermatologicals. Shortage of certain
essential medicines, especially injectables and old off‑patent medicines is a global problem. Its causes
are complex and include consolidation of the industry, production issues, outsourcing of manufacturing
to India and China, administrative actions against manufacturers for good manufacture practice (GMP)
non‑compliance, unavailability of raw materials, trade barriers, as well as discontinuation of production
for purely business reasons. Government Accountability Office report from July 2016 scrutinizes in
6. detail causes of shortages in the US and suggests solutions at national level. Health systems have often
difficulty defining their populations’ needs. At the same time, hospitals are highly restricted in their
choices beyond the sole criterion of price. WHO report (2016) suggested guaranteed minimum prices for
certain essential drugs to ensure their availability in appropriate quality.

In the Czech Republic, there are currently 58 217 variants of medicinal products, i.e., including all
pharmaceutical forms, strengths and package sizes. Of these more than 58 000 drug options, only 8 157
(14%) were actively traded in the last quarter of 2016. According to the State Institute for Drug Control
(SIDC, Státní ústav pro kontrolu léčiv, SÚKL), there is considerable interest in registering medicinal
products on the Czech market. However, it is up to the marketing authorization holder to decide whether
the authorized medicinal product will be available to patients. The number of authorized, yet not
marketed medicines in the Czech Republic now reaches to 50 000. Given the fact that if necessary, drugs
authorized for marketing in another EU country can be used [4] the fact that the absence of marketing
authorization and consequent unavailability is not a reason for panic. The question is, however, whether
such an emergency procedure is the best and most economical solution.
The Czech Republic is a small market with complicated rules, often different from those of the European Union
(EU). Rules for the enforcement of regulations are not always seen as transparent. For risk managers in the
industry, the most critical clues include the history of enforcement of regulations, consistency of imposing
administrative sanctions against various entities, the predictability of government actions, and the likelihood of the
state administration being influenced by political changes and moods in the country. A glaring example is the
confusing use of the standard terminology 'qualified person' and 'responsible person' and the definition of their
competencies, roles in the distribution of medicinal products, and their position in the organizational structure of
the company [ 5].
A good example is an inspection at the pharmaceutical warehouse in Rudná in January 2017, the result of
which is available to view in the EudraGMDP database. This finding merely refers to Article 84 of Directive
2001/83/EC, which only orders the implementation of the Guidance on Good Distribution Practice.
Moreover, the document published online, is still marked as confidential [6]. Transparency in the area of
sanctions is one of the basic prerequisites for the function of the state administration. For example, the US
Food and Drug Administration (FDA) publishes letters to controlled entities [7]. The professional public can
download all these letters and examine them in detail.
For the pharmaceutical industry as well as for investors, it is crucial to know how the authorities deal with
standard situations, whether they apply the law consistently, and whether and how it is possible to defend
against unfair trading practices, including corruption [8]. Legal-administrative uncertainty, unclear rules for
pricing, and environment lacking transparency can discourage many pharmaceutical companies from
launching medicines on the Czech market. Czech media has been paying attention to the issue of drug
availability for a very long time [9]. The current situation is often blamed on re-export, but also on the
pricing level of medicinal products in the Czech Republic as compared with the rest of Europe. However, I
have not found a study of the current situation, root cause analysis, a comparison with other countries around
the world, or suggested solutions. A detailed study should serve as the basis for the preparation of the
amendment to the Act on Pharmaceuticals. The first step in moderating the debate on such topic is to specify
which medicines are available on Czech market, which are missing, and for what reason.
The data analysis performed by our company [10] compares the total number of marketing
authorizations on the Czech market and the number of marketed products, as well as medicines
available on the Czech market with the World Health Organization (WHO) list of essential medicines,
7. see Table 1, Charts 1-3 [11]. The visualization shows that some drugs are receiving unprecedented
attention: e.g., pregabalin, a drug used to treat anxiety, neuropathic pain, and seizures, was the winner
with the highest number of 1 190 registrations (48 marketed).
This drug is also remarkably popular on the black market. The most numerously represented drug
classes are products for the treatment of the nervous system, as well as medications for the treatment of
cardiovascular diseases (Chart 2). In other groups, the choice of drugs and their availability are
disproportionately poor. Examples include dermatologicals, antimicrobial drugs - especially against
mycobacteria, anti-viral agents, sera, immunoglobulins, and vaccines, in addition to certain
oncologicals, immunosuppressants, anesthetics and other drugs. Antiparasitics are the least represented
drugs on the Czech market: out of a total of 21 registrations for the entire indication group, only seven
were marketed in the last quarter of last year.
A list of all 427 indispensable medicines can be found in Annex 3 of the WHO Technical Report
[12]. Of these irreplaceable drugs, 135 (i.e., 32%) are currently unavailable in the Czech Republic.
Anti-infectives are the worst affected (out of 119 indispensable, 39 are not available), dermatologicals
(out of 21 essential, 12 are missing), and previously mentioned antiparasitics (out of 36 essential, 30 are
missing). A detailed analysis by organ system is available for inspection and download on the Arete-

Shortages of essential medicines, in particular of infusions and injectables, are not a problem unique
to the Czech Republic. The pharmaceutical industry has changed significantly since the 1980s:
pharmaceutical companies have expanded as a result of mergers [13], and numerous functions are now
outsourced to cheaper regions, mostly in Asia [14]. Globalization brings a multitude of changes, from
the opportunity to obtain cheap goods from the other side of the world and the need to import these
goods all over the Globe, to the need for oversight to ensure the acceptable quality [15].
The FDA is the most active in this respect, actively inspecting Indian and Chinese pharmaceutical
manufacturers before their products reach the US market [16]; the FDA also maintains a database of
drug shortages [17] and prepares an annual report to Congress [18]. In July 2016, the Responsible
Government Office (GAO) issued a detailed report on the causes of drug shortages and possible
solutions [19].
In January 2016, the WHO published a report [20] on how to address the unavailability of certain
medicines in developed and developing countries alike. The shortages mainly affect older, off-patent drugs
that require a demanding manufacturing process. There are multiple causes: in particular difficulties in
obtaining chemical materials for production, followed by manufacturing problems, a limited number of
producers of certain source chemicals, administrative measures against manufacturers, in particular by the
FDA against producers in India and China, and trade barriers to the access to the market. Many older
medicines are abandoned by manufacturers for purely business reasons. Newer drugs in the same indication
group are more profitable, although not always justified for all patient groups. Studies from different
countries have identified new technologies as one of the critical causes of the unavailability of certain
medicines [21].
Unfortunately, health systems in developed countries, and even more so in developing countries, have
difficulty in defining what medicines and in what amounts their populations need. In many countries,
hospitals buy on the lowest possible bid, without the choice of source, distributor, supply route and delivery
method, quality of supply chain security, and without the option to take into account other criteria. The
relatively low volume of last-minute deliveries in relatively small quantities combined with constant price
pressure makes some essential medicines not profitable. In addition to notification systems and a global
database of vulnerable drugs, the WHO also recommends minimum price agreements for certain products to
ensure their availability as well as adequate quality.
