More specifically,Article 44of the PropertyActand otherreal rightsstipulatesthatco-ownersmay
agree to manage the affairsof a personasmanagerwho will actas theirpledgee.Foramanager,
theycan choose one or several of them,andcan alsoentrustthe managementtoany otherbusiness-
able physical orlegal person.
Furthermore,bythe provision of Article378 of the same Law (which,accordingtoArticle 374 of the
Act appliestothe co-ownersrelationshipwhiletheirrelationsdonotcomplywiththe provisionsof
Chapter4 of the third part of that Act, or until the ownershipof aspecial partof the propertyis
established) Isthatthe real estate ownersare obligedtoentrustthe real estate managementtasksto
the managerin accordance withthe contract theymake withthe manager,andthat the manager
may be a natural or legal personregisteredfordoingthesejobs.
The two provisionsare similarinsubstance with upravljanje zgradama,since theybothprescribe
the possibilityforanatural and legal persontobe the managerof a building.However,Article378 of
the Law on PropertyandOther Real Rightsfor the BuildingManagerimposesanotheradditional
requirement,namelythatitisa personwhoisregisteredforperforminghousingmanagement
activities.
As faras we knowit,inpractice,regardlessof whetheritisamanagementof a residentialbuildingon
whichthe ownershipof aspecial partof a propertyor a buildinginwhichthatpropertyhasnotyet
beenestablished,doesnotpermitthe workof a buildingmanagertobe performedbya natural
personwhoisnot registeredforPerforming the managementof residential buildings.
Accordingto judicial practice,thispossibilitydoesnotexistforsome legal entities.Namely,acitizen's
associationcannot conducthousingmanagementactivitiesunderthe PropertyActandotherreal
rights.
