2 THE COURT: In my mind he did that today by pointing to the defendant here sitting beside
counsel, but at the roadside he did not identify in his notes with regards to being able to indicate that
this was Mr. Beaudrie. So I am going to indicate that the prosecutor has not proven his case and the
charge will be dismissed.
