THE FUTURE OF REGULATION 33 The Draft Children’s Homes (Amendment) Regulations 2013 Providers of Children’s Homes will soon be required to change their practice in respect of the monthly requirement for visits under Regulation 33. This will mean someone completely independent of the organisation and the day-to-day running of the home or any other home in the organisation will no longer be accepted as suitable to undertake the task.! Amendments Persons who have any interest in the running of the home, care planning, finance or administration will not be eligible to undertake visits.! The Registered Provider will be required to have their monthly visits under Regulation 33 carried out by an Independent Person.! Copies of the Independent Person’s report will be sent to HMCI, the Placing Authority, Registered Manager and Registered Individual.! Current Practice Providers large and small have over the years tended toward the practice of carrying out their own regulation visits. Organisations with more than one home have generally used their Registered Managers to carry out the monthly task of what should amount to a mini inspection on their fellow Manager’s establishments. The visit is carried out in under the requirement of Regulation 33 and as such should benchmark the service delivery and care of young people against the statutory regulation and associated minimum standard. ! WHAT IS BEHIND THE AMENDMENT? • Or those who may be regarded as having a conflict of interest! The changes are part of the government’s drive to ‘reform’ children’s homes care and improve safeguarding for looked-after children. ! Independent Person The Children’s Homes Regulations already include provisions for homes to be visited by persons/organisations who may not necessarily be directly concerned with the conduct of any individual home to report on how the home is managed and on the wellbeing of children in its care. Reports by the Office of the Children’s Commissioner and the Expert Group recommended that these visits should be more independent of the organisation providing the home and that, in future, the person/organisation responsible for these visits should be “approved” by the local authority where the home is located.!
