Dual agency is when a real estate broker represents both the buyer and the seller. Both parties must give their written consent to dual agency.
It's important that before agreeing to dual agency, both the buyer and seller understand what the PROs and CONs are to it. In some states, buyers and sellers may not encounter it because it is not legal, however, in many it is.
