Kristin Wilkinson is an experienced civil trial litigator in state and federal district and
bankruptcy courts throughout Texas, including personal injury, commercial litigation, securities
fraud, bankruptcy and commercial real estate and visiting representation pro hac vice in
commercial transaction litigation out of state.
Ms. Wilkinson’s first civil trial involved representation of a seven-year old girl molested
and sexually assaulted by a forty-seven year old lawyer in Houston, Texas. Many Houston
attorneys and judges were shocked by the allegations and the litigation was highly contentious
with multiple law firms representing the defense. While the molester was given a plea bargain in
the criminal matter, the Houston civil jury returned a verdict in favor of the young child and
compensated her with $8,910,000.00 in damages, reduced by approximately one-half by the
First Court of Appeals at Houston. The defendant was later prosecuted in federal court relating
to ongoing child pornography and served seven years in federal prison and listed as a registered
sex offender.
The defendant attempted unsuccessfully to discharge the judgment twice through
bankruptcy, initially under Chapter 7 just before trial in 2004, and again after the 2005 verdict
under Chapter 13 in 2007. The second attempt to discharge the judgment under Chapter
13 was dismissed by the defendant/judgment debtor after the creditors’ meeting in In
re Warren Reid Williamson, Debtor; CA No. 07-32826 -H5-13; United States Bankruptcy
Court for the Southern District of Texas, Houston Division.
In the first attempted discharge, through Chapter 7, the bankruptcy estate was
closed with the federal district court dischargeability question remaining for retrial after
the personal injury case was tried in state district court. The discharge was denied in In
re Warren Reid Williamson, Debtor; CA No. 04-31143; Adv. Proc. No. 04-3317 -
Objection to Dischargeability; Saskia Madison, a/n/f of Megan Madison, A Minor,
(pseudonym) v. Williamson; United States Bankruptcy Court for the Southern District of
Texas, Houston Division.
Following the completion of the bankruptcy proceedings in November 2008, a
post-judgment receiver was appointed to satisfy the judgment. To date, of all of the
properties and assets identified by Ms. Wilkinson and provided to the court’s receiver,
only $297,447.61 has been collected. Of that, a mere $71,893.85 was turned over to the
child, (the plaintiff/judgment creditor), by the receiver and his new counsel. The receiver
paid debts – of the judgment debtor – amounting to $151,405.60 – in this post-
judgment turnover proceeding filed only for the purpose of satisfying the judgment
creditor! The receiver’s and trustee’s attorney has been paid $71,893.85 in expenses.
Ms. Wilkinson has not received a dime of money recovered. She was the lawyer who
performed the work and the lawyer who represented the Plaintiff and obtained the
judgment. Her objections to the receiver’s disbursements that are, in her opinion
improper, to the receiver’s counsel, and to the child’s trustee, have been denied by the
state district court that presides over the turnover proceeding. Although Ms. Wilkinson
obtained a protective order protecting the identity of the child, the order has been
ignored by the current swarm of counsel who claim to represent the child’s best interest.
The case was filed in 2002. Ms. Wilkinson obtained the judgment in 2005 and prevailed
finally in the denial of the bankruptcy discharge attempts in November 2008. The most
recent disbursements of the money recovered were made in May 2016.
Ms. Wilkinson has also represented clients before FINRA in mortgage-backed
securities fraud litigation against UBS where Ms. Wilkinson’s clients’ accounts were frozen and
inaccessible to them shortly after they invested over $1 million. All of the clients’ invested funds
were returned to them and the arbitration proceeded on the client’s damages, all of which were
collected with interest.
Ms. Wilkinson has represented clients in other personal injury and wrongful death cases,
notably in one case that involved the wrongful death of a 15-year old child who died after
ingesting toxic levels of hydrocodone and alprazolam provided by her father during his
weekend of child custody possession and access, causing her death. The appellate court
reversed the trial court’s summary judgment and the case was settled before trial.
Other cases Ms. Wilkinson has experience in include claims relating to unpaid life
insurance claims, commercial real estate disputes, Deceptive Trade Practices Act claims, and
high-conflict family law matters. Ms. Wilkinson has appeared as a guest on Sky News radio
discussing current issues in family law.
Prior to opening her own law practice in 2003, Ms. Wilkinson worked as an attorney with
Richard Haynes & Associates, P.C., and worked as Mr. Haynes’s law clerk before being hired as
an attorney after receiving her license to practice law. Her experience included civil litigation of
personal injury, business torts, employment law and education law in Harris, Bexar, and Kerr
counties and the U.S. District Court for the Southern District of Texas from November 2001-June
2003.
Prior to attending law school, Ms. Wilkinson worked in the headquarters law department
as a paralegal at Exxon Company, USA, from 1993-1997 where her work involved upstream
marketing, downstream E&P, and real estate, while completing her undergraduate degree at
night.
