Mental health has been in the news quite a bit lately. Dozens of U.S. states are currently suing Meta for contributing to the youth mental health crisis by inserting addictive features into their products, while the U.S. Surgeon General is touring the nation to bring awareness to the growing epidemic of loneliness and isolation. The country has endured periods of low national morale, such as in the 1970s when high inflation and the energy crisis worsened public sentiment following the Vietnam War. The current mood, however, feels different. Gallup recently reported that national mental health is at an all-time low, with few bright spots to lift spirits.
To better understand how Americans are feeling and their attitudes towards mental health in general, ThinkNow conducted a nationally representative quantitative survey of 1,500 respondents and found some interesting differences among ethnic, age and gender groups.
Technology
For example, 52% agree that technology and social media have a negative impact on mental health, but when broken out by race, 61% of Whites felt technology had a negative effect, and only 48% of Hispanics thought it did.
While technology has helped us keep in touch with friends and family in faraway places, it appears to have degraded our ability to connect in person. Staying connected online is a double-edged sword since the same news feed that brings us pictures of the grandkids and fluffy kittens also feeds us news about the wars in Israel and Ukraine, the dysfunction in Washington, the latest mass shooting and the climate crisis.
Hispanics may have a built-in defense against the isolation technology breeds, owing to their large, multigenerational households, strong social support systems, and tendency to use social media to stay connected with relatives abroad.
Age and Gender
When asked how individuals rate their mental health, men rate it higher than women by 11 percentage points, and Baby Boomers rank it highest at 83%, saying it’s good or excellent vs. 57% of Gen Z saying the same.
Gen Z spends the most amount of time on social media, so the notion that social media negatively affects mental health appears to be correlated. Unfortunately, Gen Z is also the generation that’s least comfortable discussing mental health concerns with healthcare professionals. Only 40% of them state they’re comfortable discussing their issues with a professional compared to 60% of Millennials and 65% of Boomers.
Race Affects Attitudes
As seen in previous research conducted by ThinkNow, Asian Americans lag other groups when it comes to awareness of mental health issues. Twenty-four percent of Asian Americans believe that having a mental health issue is a sign of weakness compared to the 16% average for all groups. Asians are also considerably less likely to be aware of mental health services in their communities (42% vs. 55%) and most likely to seek out information on social media (51% vs. 35%).

2. Enige regsgeleerde sal getuig dat die reg onbepaalbaar en ewigdurend ontwikkelend is.
Die reg, soos enige sisteem, is nie foutloos nie en 'n regsgeleerde struikel daagliks met
onskerhede in die reg. Die plig van 'n prokureur om inligting te openbaar steun op twee
kardinale stelreëls in die Suid-Afrikanse reg naamlik: die prokureur moet in die openbare
belang optree (en dus nie die hof of gemeenskap mislei nie) en aan die ander kant moet
die prokureur in die beste belang van sy kliënt optree.
Die prokereur moet in die openbare belang optree:
Elke prokureur is deel van die “society of that province”.1
In CLS2
reel 14.3.2 word daar
gestel dat lede die belange van hul kliënte altyd moet handhaaf onderhewig aan hul plig :
14.3.2.1) tot die hof
14.3.2..2) belang van geregtigheid
14.3.2.3) waarnemings van die reg en
14.3.2.4) die handhawing van etiese standaarde in die reëls en as algemeen
aanvaar in die professie
Die vraag wat nou ontstaan is: Wat is 'n advokaat of prokueur se “plig tot die hof”?
Ek verwys na die saak van Toto v Special Investigating Unit3
waar die hof belis het dat
daar 'n plig op 'n advokaat rus - teenoor die hof en teenoor sy kliënt. Die advokaat het ook
'n plig teenoor geregtigheid en om 'n billike administrasie van geregtigheid te versker.
Voorts beslis die hof: It is within the duty of a legal representative to bring to the attention
of the court all cases and relevant authority that he/she knows about, even if such
authority would adversely affect the strength of his/her case. A failure to do so is a gross
breach of the duty.4
Daar word verder na die saak van Ex parte Swain5
verwys : The proper administration of
justice could not easily survive if the professions were not scrupulous of the truth in their
dealings with each other and with the Court."6
'n Advokaat wat toegelaat word moet die volgende eed aflë7
'I, .................... do hereby
swear/solemnly and sincerely affirm and declare/that I will truly and honestly demean
myself in the practice of advocate according to the best of my knowledge and ability, and
further, that I will be faithful to the Republic of South Africa.' Na my mening plaas
laasgenoemde 'n plig op enige advokaat om ten alle tye in goeie trou op te tree teenoor
die hof en die Republiek wat dus insluit dat 'n advokaat enige relevante dokumente aan
die hof moet openbaar wat die behulpsaam sal wees tot 'n regverdige beslissing.
Die volgende vraag wat na vore kom is: Wat is “geregtigheid”?
Die term “openbare belang” word as maatstaf in die Suid-Afrikaanse howe gebruik. Die
mees deurslaggewende saak wat na vore kom is die saak van Barkhuizen v Napier 8
.
Ngcobo R het in die saak beslis dat openbare beleid, wat onderliggend aan ons
konstitusionele demokrasie is, in die Handves van regte uiting vind :

Bogenoemde word ook ondersteun in die saak van Jordan and Another v Farber10
wat met
goedkeuring na die Barkhuizen-saak verwys en belsis dat ons howe kontrakte wat teen die
openbare beleid is ongeldig moet verklaar.
Dus met verwysing na die bogenoemde kan daar duidelik gesien word dat indien daar in
“n kontrak gestel is dat die advokaat/prokereur net in die beste belang van sy kliënt moet
optree, al het dit met gevolg dat dit teen die openbare belang gaan indruis, daardie
bepaling onafdwingbaar sal wees.
Reël 89 van die Law society van die Noordelike profinsie en die reël van “geskik en
gepas”:
Wat is etiese optrede en die gedragskode wat prokereurs moet volg? Soos gestel in die
volgende artikel:11
...rule 89 of the Law Society [of the Northern Provinces], which enjoins
members not to make themselves guilty of “unprofessional or dishonourable or unworthy
conduct”
Die bogenoemde reël sit 'n lys van onprofessionele gedrag van prokureurs uiteen soos
byvoorbeeld reël 89.15 : om nie behoorlik na die belange van die kliënt om te sien nie en
reël 89.30 : om nie die mate van professionaliteit voorendag te lê wat redelikerwys van 'n
regspraktisyn verwag word nie.
Sodanige versuim sal as “unprofessional or dishonourable or unworthy conduct,”
geklassifiseer word wat moontlik, itv art 7(1)(d) van die Toelating van Prokereurs wet 74
van 1964, 'n skrapping van die rol tot gevolg kan hê as daar gevind is dat die prokureur /
advokaat nie “geskik en gepas is nie”. Vervolgens sit Lewis12
die term “unworthy conduct”
duidelik in sy “goue reël” uiteen: a practitioner must avoid all conduct which, if known,
could damage his or her reputation as an honourable lawyer and honourable citizen.
Die term “geskik en gepas “ word uiteengesit in die bekende saak van Prince v Preisdent,
Cape Law Society13
waar die hof vir Prince van die rol geskrap het agv sy gebruik van
cannabis “ dagga”. Die hof het die volgende stelling gemaak : a person who declares his
intention to continue breaking the law is not a fit and proper person to be admitted as an
attorney.14
Om geskik en gepas te wees, sê Du Plessis,15
sluit integriteit, objektiwiteit,
waardigheid, besit van kennis en vaardighede, harde werk, respek vir die regsorde en
billikheid in. Die vereiste om “geskik en gepas” te wees is nie gedefinieer in wetgewing nie,
ten spyte van die feit dat dit 'n streng vereiste is. Dus is dit 'n waardeoordeel deur die hof
en is oor die jare deur howe op 'n subjetiewe basis geinterpreteer op 'n saak tot saak
basis.
Die prokereur moet in die beste belang van sy kliënt optree:

Die hof in S v Ntuli17
beslis as volg:
There are, of course, limitations to the content of counsel's argument. Counsel may not
misrepresent the facts or the law. At a minimum, however, counsel is required to uphold
the interests of his or her client without fear of the consequences .18
In die saak van Van der Berg v The General Council of the Bar19
moes die Hoogste Hof
van Appèl besluit of 'n advokaat wat na sy eie ondersoeke uitgevind het dat sy kliënt se
bewerings vals was en steeds beëdigde verklarings opgestel het om die bewerings te
handhaaf, 'n verbreking van sy plig tot die hof ondergaan het deur om nie laasgenoemde
te openbaar nie. Die hof het vermeld dat20
: An advocate is not called upon to believe, to
any degree, the evidence that he is instructed to place before a court. Even if he believes
positively that his client’s evidence is false, he is entitled, and indeed obliged, to place it
before a court if those are his client’s instructions, and there can be no qualification in that
regard.
Die hof gaan voort en beslis dat wat verder gese word van 'n “advokaat” is ook van
toepassing op 'n prokureur aangesien hulle dieslefde rol speel en dit is ook die benadering
wat vervolgens gevolg word. Die hof beslis dat 'n advokaat 'n nodige rol in geregtigheid
verwesenlik en dat advokate in elke geval besef dat die kliënt 'n reg tot 'n billike verhoor
het. Daardie reg (vervat in artikel 34 van ons Grondwet) sal op inbreuk gemaak word
indien die advokaat alle getuienis van sy kliënt moet glo en dit sal beteken dat die regte
van die kliënt deur die advokaat en nie deur die hof bepaal word nie nie. David Pannick
QC skryf in sy boek ‘Advocates’ :The advocate’s duty to his client authorizes and obliges
the advocate to say all that the client would say for himself (were he able to do so)...
Grondwet van die Republiek van S.A, 1996
Ek vind dit net gepas om ook artikel 34 van die Grondwet te noem wat meld: Elkeen het
die reg dat 'n geskil wat deur die toepassing van die reg besleg kan word, in 'n billike
openbare verhoor beslis word voor 'n hof... De Vos dui aan dat die reg op ‘n billike verhoor
die basis van die Siviele Prosesreg vorm21
. Na my mening, aangesien ons onself in 'n era
van Grondwetlike oppergesag bevind, moet die eitlike vraag wentel rondom artikel 34 en
die Handves van Regte. Die reg vervat in art 34 sluit die applikant en verweerder se regte
in. Dus, na my mening, indien die advokaat nie relevante dokumentasie openbaar nie sal
dit inbreuk maak op die applikant se reg op 'n billike verhoor en is nie regverdigbaar itv
artikel 36 van Die Grondwet nie.
Sou dit 'n verskil maak as my kliënt nie “'n gesiglose maatskappy was nie...?”:
Om die vraag te beantwoord word daar slegs verwys na artikel 9 van die Grondwet, reg op
gelykheid, wat stel dat elkeen gelyk is voor die reg en die reg op gekyke beskerming van
die reg het. In my opinie sal dit dus geensins 'n verskil maak wie die kliënt is nie. Met 'n
direkte toepassing van artikel 9 op die feite moet alle mense gelyk behandel word en
vervolgens kan een persoon (net omdat hy byvoobeeld 'n gesin het) nie voorkeur geniet

Slot:
Soos vroeër vermeld is die reg onbepaalbaar en regters en advokate staar daagliks
regsonsekerheid in die gesig. Om openbare mening, geregtigheid en dan ook die belange
van jou kliënt teen mekaar op te weeg is iets wat 'n advokaat op n daaglikse basis sal
moet doen. Na aanleiding van die bogenoemde gesag is daar nie sekerheid oor presies
wat die korrekte roete is om te volg nie. Dit is wel duidelik dat 'n advokaat geregtigheid
moet nastreef, die waardes van die Republiek moet verwesenlik en bevorder en gefokus
moet wees op die soeke na waarheid, al beteken dit dat hy dalk finansieël slegter af sal
wees. Vervolgens sal ek, as prokureur in die geval, die dokument aan die hof voorhou,
ongeag die opdrag van die advokaat, want dit is die etiese keuse tussen die alternatiewe.
Dus verwys ek met goedkeuring na die volgende stelling: I believe that the ultimate
beneficiary will no doubt be the administration of justice.22
