 REMOTE WORKING: New Rules
In an effort to bring Romanian legislation in line with European
practice and current working conditions in light of the
development of technological means of communication,
Romania has just adopted a special law on remote working.
Law no. 81/2018 on remote working was published in Official
Journal no. 296/02.04.2018 and has entered into force on
05.04.2018. Thus, without canceling in any way the provision of
the Romanian Labor Code regarding "work from home", the new
law expressly regulates the situation in which the employee
works: at his/her usual place of residence; in another place

 TAX AUDIT OF RESIDENT NATURAL PERSONS
After a very active period in terms of new tax regulations
introduced by the authorities, new rules aimed at verifying the
fiscal situation of natural persons resident in Romania have
become effective on 23.03.2018. In this article, we try to review
the most important legal provisions recently adopted on this
subject, namely the Order of the President of the National Tax
Agency no. 675 of 15 March 2018 approving the indirect
methods of income determination and their application
procedure, published in the Official Journal no. 257. READ

 THE EUROPEAN ACCOUNT PRESERVATION ORDER
The development of commercial relations increases the
difficulties encountered by creditors in collecting their claims
from debtors in other EU countries.
To mitigate this risk, the EU has adopted Regulation no.
655/2014 of 15 May 2014 establishing a European Account
Preservation Order procedure. Through this procedure and
under certain conditions, the accounts of a debtor can be
preserved at the creditor’s request. This Regulation also applies
in Romania as from 18 January 2017. READ MORE

 MICROENTERPRISES: POSSIBILITY TO OPT
FOR THE CORPORATE TAX
Long-expected and heavily debated by
the business environment, the
Government Ordinance allowing
microenterprises to opt again for the
corporate tax has just been published in
Official Journal no. 291 as of 30.03.2018
(OUG no. 25/29 March 2018).
We hereby remind you that the rule is that
microenterprises pay a flat-rate tax on
turnover and not a corporate tax, as
follows:
1. 1% of turnover if they have 1 or more
employees;
2. 3% of turnover if they have no
employees.
The turnover threshold below which a
company is considered a microenterprise
for taxation purposes is 1 million Euros
(the equivalent in Lei). READ MORE

Ambassador in Paris, an honorific position recognizing
her involvement and the support she has been offering
to the cause of repatriation through entrepreneurship of
Romanians from the Diaspora. RePatriot is a project
aimed at the repatriation through entrepreneurship of
Romanians from the Diaspora, a project launched by
Romanian Business Leaders Foundation. In total,
RePatriot currently has 59 honorary ambassadors .
Personal data: The European Regulation comes
into force starting from May 25, 2018
Starting from May 25, 2018, the date of entry into force of the General Regulation on the protection of individuals with regard
to the processing of personal data and the free movement of such data, all companies operating in the EU, regardless of
where they are established, will have to follow a set of rules on data protection. According to the European Commission, the
strengthening of data protection rules means that citizens will have better control over their personal data and, at the same
time, that companies will benefit from fair competitive conditions.
