Don’t assume you can’t collect money from the BP settlement just
because you didn’t get a class action notice in the mail

While hotel chains, fisherman and others along the Gulf Coast obviously have legitimate claims
against British Petroleum (BP) for losses due to the company’s 2010 oil spill, the disaster’s
indirect impact on many other businesses isn’t apparent, and BP is happy to keep people in the
dark. They don’t want you to know that your business could be owed money from the BP
settlement, even though BP didn’t send you notice of the class action in its recent (estimated)
$7.8 billion Deepwater Horizon oil spill settlement.
BP didn’t negotiate a cap on the amount of money that could be paid out through the BP
settlement. But it did several things to try to hold down the settlement’s cost, such as failing to
give individual notice by mail to most BP settlement class members.
But BP’s efforts to hold down the cost of the Deepwater Horizon settlement have not been as
successful as BP had hoped. Patrick Juneau, the Administrator of the BP Settlement Fund, is
paying BP claims at a far higher rate than British Petroleum expected. So BP recently started
filing motions attacking the Settlement Administrator, pointing out what BP calls “absurd” results.

One of those so­called “absurd” results was a $9.7 million payment to a North Alabama paving
contractor. Yet many people in north and central Alabama still don’t know they’re eligible to file a
BP claim. And that’s the way BP wants it.
During their lifetime, most people have been mailed at least one of those cards informing them
that they could be part of a class action settlement, but often the amount they might win in the
settlement seems too small to bother with the paperwork. In the case of BP’s oil spill settlement,
to protect its bottom line the company didn’t send many people notice of the class action. We
are not talking five or ten bucks here—you could be missing out on substantial funds rightly
owed to you, if you don’t join the BP settlement class.
A business needn’t be located close to
the coast to be deserving of pay for
money damages from BP, which like most
large companies receives millions in aid
from governments. About 500,000 people
were notified that they could be members
of this BP settlement class—far fewer
than those affected by the oil spill. Many
more business owners in Alabama,
Mississippi, Louisiana and Florida are
missing out on BP settlement checks that
they are rightfully owed, and you might be
one of them, but the energy giant doesn’t
want you to know.
BP could have bought all mailing lists for
businesses in the four affected states and notified all of the owners, but that would cost it a lot
more money. If BP could have kept it a secret that a Louisiana rice mill 40 miles inland was
owed money, or a paving contractor in North Alabama was owed money, the company would
have saved more than $30 million between those two claimants. You might not realize it, but BP
knows that the numbers add up here, and not in its favor.
Just as bad work practices used to save money contributed to the 2010 Deepwater Horizon oil
rig explosion that killed 11 people and thousands of animals and fish, BP also is trying to save

bucks by not notifying everyone who might justifiably be paid for business losses due to the
disaster. So are you going to take it on the chin, as so many small businessmen are used to
doing, or are you going to fight for what is your due? The choice is yours; the time investment
you will make to be paid back from BP is minimal compared to the payment you will miss if you
don’t. The BP settlement agreement says that the BP settlement fund will pay attorneys’ fees for
people and businesses who hire lawyers to handle their BP settlement claims.
So it won’t cost you any money out of your pocket, and you won’t have to file a lawsuit against
BP. Instead you can use the much­faster BP claims process to collect any money you may be
owed. The BP Settlement Administrator, Patrick Juneau, was quoted in a Nola.com article giving
advice to people who may be entitled to BP settlement money. What was the BP Settlement
Administrator’s advice? “When in doubt, file a claim.”
