National Agency for Social Benefits

      Family Benefits Sector
trESS
The Ministry of Labour, Family and Social Protection,
as competent authority, develops the legal framework
for the implementation of the Community regulations
in the family benefits field.
The National Agency for Social Benefits is the liaison
body in Romania for the family benefits sector since
the 1st of may 2009
At territorial level, the National Agency for Social
Benefits coordinates the County Agencies for Social
Benefits, these being also the competent institutions
with the payment of the benefits
trESS
The family benefits granted in Romania and
that are under the provisions of the new
Regulation are:
the state allowance for child,
 the child raising monthly benefit and monthly
stimulant,
 the special stimulant and monthly benefit for
raising the disabled child.
trESS
The state allowance for child is a main right
of the child and is granted per child and
regardless of the parent’s income, their
profitable situation or family constitution. The
amount of the state child allowance until the
age of 2 years is of 200 lei monthly (≈ 50Euro)
and after the age of 2 years the amount is of
42 lei monthly (≈10Euro). The disabled
children after the age of 2 years receive state
allowance as the law stipulates, increased to
100%
trESS
The monthly benefit for sustaining the family
in raising the child and the special monthly
benefit for raising the disabled child is granted
monthly to one of the parents until the age of
1 year or 2 years of the child according to the
parent option or 3 years for disabled child.
 The amount of the child raise benefit is of
  75% of the average of the income
  accomplished in the last 12 months before
  the child birth but no more than 3400 lei
  monthly (≈800Euro)or less then 600 lei
  (≈150Euro) for a parental leave until the age
  of 1 year of the child and no more than 1200
  lei (≈300Euro) monthly or less then 600 lei for
  a parental leave until the age of 2 years of
  the child.
trESS
 The payment of the monthly child benefit is
suspended if the beneficiary receives an
income due to a professional activity and this
income is taxed and in this case the
beneficiary receives a monthly stimulant, if he
made the option for a parental leave until the
age of 1 year of the child.
trESS
During the transition period our actions to
adjust to the new Regulation provisions
focused mostly on:
- Staff Training;
- Informing the beneficiaries about the
changes;
- Adjusting the internal procedures.
trESS
 In may 2010 we had a face to face training
  session with staff involved directly in
  applying the new provisions at the county
  level.
 Another face to face training session with
  the agencies managers took place in April
  2011.
• Permanent support is offered to staff via e-
  mail and telephone.
trESS
All the information regarding the rights and
the obligations of the migrant workers
occurring from the Regulations 883/2004 and
the implementation Regulation can be found
on the web page of the National Agency for
Social Benefits – www.prestatiisociale.ro
Answers to most frequent questions and a
practical guide are also available online.
Some e-mail communication with other trESS
institution has been done via e-mail. E-forms
and the new SED s have been transmitted via
e-mail as well.
Around 100 SED-s have been filled out by our
staff (mainly F001, F002 and F003), but this is
only around 5 percent of the total forms
exchanged at the country level. Most member
states still use the old E-forms .
We use mainly E-forms as well because they
are much shorter and easy to submit via post.
Problems :
                                                 trESS
Staff shortage in our local agencies and in the same
time the number of forms we exchange doubled
compared to 2009 due to economic situation (many
workers are returning to Romania from some
member states affected by the crisis like Spain and
others are leaving in states where the economic
prospects are better than in Romania).
This year we received a higher number of incomplete
forms (information lacking so we are unable to
identify the persons in our database).
The communication with the institution from the
member states still requires long periods of time.
