Addendum 1 Divine Highlands

  1. 1. DIVINE HIGHLANDS SITE CONDOMINIUM ADDENDUM #1 To Purchasers: You are hereby advised that Sections 84 and 84(a) of the Condominium Act provide, in part, as follows: 1.) At least nine business days before a condominium unit is conveyed or nine business days before the Purchase Agreement becomes a binding agreement, the Developer shall have provided a prospective purchaser with copies of the following document relative to the condominium project: A. The recorded master Deed including the Condominium By-Laws and the Subdivision Plans; B. An executed copy of the Purchase Agreement to which is attached a copy of the Escrow Agreement; C. A condominium Buyer’s Handbook containing, in a prominent location and in boldface type, the name, telephone number and address of the person designated by the Michigan Department of Consumer and Industry Services to respond to complaints; D. A Disclosure Statement; E. Articles of Incorporation of the Condominium Association; F. Condominium Association By-Laws. The calculation of the nine business day period shall include the day on which the above listed documents are received, if that day is a business day. 2.) This time limit may be waived in exceptional cases by a purchaser who has been provided all of the above documents, and waives in writing, on a form approved by the administrator, the purchaser’s right to the protection provided by the advance review time. 3.) The form, attached to this Purchase Agreement as Addendum Number II signed by a purchaser, acknowledging receipt of the above documents, is prima facie evidence that the documents were received and understood by purchaser. 4.) The Purchase Agreement of which this Addendum is a part may be amended by agreement of the Purchaser and Developer before or after the Agreement is signed. An amendment to the Purchase Agreement does not afford the Purchaser any additional right or time in which to withdraw other than as is provided in Addendum Number II to the Purchase Agreement. Further, an amendment to the Condominium documents effect in the manner provided in the documents or provided by law likewise does not afford the Purchaser any additional right or time in which to withdraw other than the time period provided in Addendum Number II to the Purchase Agreement.
